Those were provisions of the two-year probation the 22-year-old University of Oregon senior was handed Tuesday. Levy pleaded guilty in August, becoming the first person convicted under the 1997 No Electronic Theft Act, a federal anti-piracy law. Levy called the sentence "harsh." "They wanted to paint me in this kingpin sort of light." — Jeffrey Levy, convicted of illegally distributing MP3s "I'm not going to deny there was a lot of stuff," he said. "But they wanted to paint me in this kingpin sort of light." Assistant U.S. Attorney Sean Hoar, who prosecuted the case in Eugene, Ore., said, "Copyright infringement on the Net is theft, and people will be held accountable for it." Hoar said if authorities had been able to gauge more accurately how much material was distributed, they could have pressed for three years in prison and a $250,000 fine. Levy, whose home computer contained music by such popular acts as "Sweet Surrender" (RealAudio excerpt) singer Sarah McLachlan, entered a plea agreement with prosecutors that said he would be charged only for damages on a typical day that music, movies, games and software were distributed from his university account. Hoar's office estimated copyright owners lost $10,000 in royalties on Jan. 16. Levy, a Phish and Grateful Dead fan, forfeited the right to appeal the sentence as part of the plea agreement, his lawyer, Shaun McCrea, said. But she said she will contest the Internet provision on the grounds that it will interfere with Levy's research for his senior thesis. The sentence bars him from home Internet access, as well as from owning a CD recorder during the probation period. Levy received two years of probation instead of one because he twice tested positive for marijuana use after the conviction, Hoar said. Under sentencing guidelines, U.S. District Court Judge Michael Hogan could have given Levy six months in prison, McCrea said. The near-CD-quality MP3 music format has exploded in popularity during the past two years, especially on college campuses with robust Internet systems. The MP3 format allows music to be distributed quickly online, but it contains no measures to prevent unauthorized distribution. Levy said he traded music and other materials rather than distributing them freely. He said he had dozens of songs on the FTP (file transfer protocol) server in his Eugene residence. Hoar said there were nearly 1,000 music files. On Tuesday, Levy called on people to re-examine the No Electronic Theft Act. "It allows basically the government to come into anyone's home and bust you for copying a tape to a CD or any sort of other thing where you're not getting any sort of profit," he said. The law makes it illegal to reproduce or distribute copyrighted works, such as software programs and music recordings, even if the person doing so has no intention of making money. Under standard probation rules, Levy will not be allowed to leave Oregon without permission, McCrea said.
