Me and my friend lined up for about an houre before the doors opened at 7 in the freezing cold, grabbed our positions right at the front on the right, next to the speakers. We took turns in getting our bff tshirts and I got the last girl one, which actually fitted not like their last tour top! Anyway, Pollyanna, an aussie band, opened at 8, had about a 45 minute set and they were really good! Before Pollyanna and during Pollyanna, I kept on trying to look through the doors to backstage when people/security were coming in and out and saw glimpses of Ben Folds and saw his wife, Frally. Ben Folds Five came on at around 9:15 and opened up with Don't Change Your Plans, followed by Emaline, then Army, Alice Childress (I can't remember the order beyond this point), Magic, Mess, Your Redneck Past, Regrets, Hospital Song, Uncle Walter, Philosophy, Underground, Fair, Quami's last night in town (previously known as Steven's!), Narcolepsy, One Angry Dwarf & 200 solemn faces, then encored with Brick (Ben said something like "To quote Thom Yorke, we still play this song") and Song for the Dumped. They also made up a couple of songs too, one about Robert Sledge's shirt cause this girl yelled out "Ben I like Robert's shirt, do u wanna make a song about it?" or something along the lines of that! I tried to throw something on stage, to Robert cause we were really near him but I didn't make the stage!!! After they finished, we found thanks to a security guard's tip off, the exit for the band and hung around there with about 8 other bff fans. After waiting for approximately half an hour, Darren Jessee came out and I got him to sign the cover of the first BFF album and a photo with him. After he went, Raykee (i don't know if that's right!), the bassist from Pollyanna came out and I started talking to her and she was really, really nice and has the coolest taste in clothes and glasses and accessories!! Robert soon came out and I got him to sign my ticket and the album cover and my friend got a photo with him and I tried to but he had to go. Robert and Darren were soooooooo nice, I can't believe I met them!! I'm getting the photos developed tomorrow, so when I see photographic proof, it will sink in!!! The copyright is not on the recording of the song, it is on the song itself, but I repeat myself (wow, two reflexives in one sentence). But you are right, you don't need permission to infringe copyright or shoot someone in the head. Say that Liz Phair decides to do a cover of "Ironic" by Alanis Morrisette. She may perform the song differently (she obviously won't sound like Alanis, thankfully) but the song will still be recognizable as "Ironic" by Alanis Morrisette, otherwise, what's the point? The copyright still applies to that song. It's self-evident. Bands cover songs by other bands all the time, probably without getting express permission. Sure, that's fine as long as they don't try to pass it off as their own: (See, Vanilla Ice vs. Bowie and Queen, :) But I would guess that would fall under fair-use and all that. If they wanted to record the song and release it on a commercial release, they may have to get permission and certainly pay royalties on the song. The "proof" you give that a live recording is not copyright infringement has more to do with sharing names of songs (probably not copyrightable) than with the actual song itself. Take, for example, all the songs called "Creep." They're all totally different and only related by name. (TLC, Radiohead, some other band that's not coming to mind at the moment.) Anyway. In fact, Support system has been a pretty good place to help me remember that there's more music in the world than just the Dave Matthews Band. Rather than try and argue these points I will simply state the consensus feelings of the "hardcore" Dave fans (much like we are the hardcore Liz fans). The following of the hardcore fans is almost identical to that of the Grateful Dead (in fact probably even more intense because of their ability to communicate and share information being so much greater nowadays). As far as the bootlegs, the band allows people to tape shows. If you ever go to show you'll see half a dozen mic stands with DAT equipment hooked up to them in the crowd. The band authorizes taping for personal use. It was the taping that help them build their fan base. The reason they crack down on the boots in records stores is because they want them to be traded for free. We make a big deal about it here that the 3 or 4 bootleg type recordings of Liz's get sold off by "scalpers" at outrageous prices. Imagine if you had 400 recordings like that (most of which are near soundboard quality). What would you do? DMband, Phish, and the Dead are all trying to stop the EBay stuff (the same way we do)in regards to their recordings and I think they should be commended for it. As far as the song names. The band never cared much for naming songs so they just used a lot of the one word titles they cue eachother with on stage. They are not trying to make a statement with them. Hence the song names like #41, #36, and #34. They were simply the 41st, 36th and 34th songs that they wrote. They've got a wicked little song called "The song that Jane likes". It's called that because it's the song the Dave's sister Jane likes. They're into playing music, not naming songs. As far as Soul Coughing.....um before you take exception...you should consider that those bands have played together on several occasions and are good friends with a very similar fan base (again, this the hardcore fans, not the radio fans). Both these bands love jamming and just saying whatever comes out of their mouths. What fun would it be to cover a song if you had to do it "exactly" right. Not to mention, Dave's usually pretty baked on stage so give him a break!!!! If you want to track down some awesome Soul Coughing bootlegs, the best place to start is with a DMBand trader. Some have dozens. The 5 or 6 thousand hardcore DMB fans out there hate the teeny bop and drunken frat-boys who seem to have latched onto the music. The DMB community used to be a lot like this one until they hit some kind of critical mass a couple of years ago. The songs that have been released on the radio are easily some of the least popular songs. You could have gone to 6 straight shows at one point this summer and not heard "Crash". They played 52 different songs during this tour. I saw them 2 nights at the Gorge and they only repeated 1 song during 6 hours of music. AND....It's not just Dave MATTHEWS!!! It's a 5 person band (+ more sometimes). It's not about Dave. Is about fusing Drums, Sax, Violin, Bass and Acousitc Guitar. Take away Dave's voice (I admit that his voice can be annoying sometimes) and these guys are even more phenomenal. I don't really want to talk about Dave here anymore.
