Jeff asked: >One question I have before I start burning 200 somthing CDs for her fans is >if it is legal or is Liz gona sue the pants off me? It's always illegal and dishonest to burn CDs or make tapes of an artist's work for other people. However, if you're talking Girlysounds or something that wasn't ever available commercially, then you've got more leeway. They CAN sue you, but probably won't. Just a warning, though...record companies and music publishers monitor artist mailing lists and newsgroups. I've been on two lists that got into hot water for discussing trades of copyrighted material openly. Support System doesn't seem to have that trouble, but you never know. Don't ever trade MP3s or CDRs of Liz's stuff that can be bought in stores, though! SERIOUSLY, that does nothing but hurt her. She's a marginally-selling artist to begin with, and she needs every sale she can get. It's an utter fucking myth that MP3s and CDR circulation doesn't hurt artists. They do. Period. Artists need to sell records and T-shirts, whether they're on a label or doing it themselves. If you doubt me, ask Jen Trynin or Frank Tovey, two of my very favorite artists, who are no longer making music actively. That "punk rawk/only doin' it for the love of music" stuff is a nice sentiment, but it's bullshit and out of touch with reality. If you're a fan, you owe it to the artist to support her/him financially. I'm not saying that you need to make them millionaires, but you'd be floored at how little money most musicians make from their music, both inside and outside of the record-company system. (Re: Bounced messages) [I posted this quite some time ago, but thought a repost of it now would be appropiate. All of these things are just common sense, and have all been said several times before. Sorry to always be harping about this, but right now I am job hunting while still working at my current job, and I just don't have time to deal with bounced messages, especially those due to careless posting. Thanks. - JL] Hey everyone, Usually I'm fairly easy-going as the owner of this mailing list, but at this time, I would like to make a few requests of everyone: 1. If you have multiple email accounts, please remember to post from the one you use to subscribe to the list. Otherwise your messages will just bounce to me and will not make it to the list until I have a chance to forward them. 2. Do not send unsubscribe requests to the list. This sends your message to the list itself, and quite frankly, there's nothing that anyone can do to help you. Please follow the instructions for unsubscribing as they appeared in the welcome message you received when you first joined the list. If you no longer have this message, you can find the information on the web at . Or, if you're really desperate, email me privately and I'll remove you from the list myself. Just don't clutter the list with administrative requests -- you'll just end up frustrating the members of the list who have to read them, and you'll also end up a little frustrated yourself to find that you're still subscribed to the list. 3. Do not send HTML-encoded messages to the list. You may be unaware that you are doing this, as the message will look normal to you. However, not all mail readers can handle this type of mail (for example, those using Unix shells). These messages do bounce from the list for a reason, and once again, won't make it through until I have a chance to forward them myself after deleting the HTML content. If you are using any mail program built into a web browser (IE, Netscape, etc.), make sure your options are set for 'plain-text' only. 4. Please use common sense when posting. For example, if your signature file is longer than your message itself, please do not include it. Also, be responsible when quoting from previous digests. Include just enough so that people can see what you are responding to and can easily follow the thread, but do not quote excessively or unnecessarily. Whatever you do, DO NOT quote the entire previous digest -- common sense should dictate that no one really needs to read the entire previous digest again. These messages are always too long for the listserve to handle and will only bounce to me anyway, but if they were to go through, you can bet a lot of people would be annoyed by this needless cluttering of the list. 5. Make sure you send all messages for the list to , which is the address for posting. Do not send them to any other variation of this address, such as or . These just send the messages directly to me, not to the list. I'm sorry if this comes off as being a little harsh -- I really hate playing the bad guy, but it seemed that a refresher on list etiquette was needed. She had on a black tight pants and a see thru tank top with white straps -yes, it was see-thru, thank you very much =). The band consisted of: the drummer, Buddy, Janet, and I think one or two other guys playing guitar or bass - couldn't see them really well to tell if they were techies or playing the instruments - sorry I'm only 5 2 and all of these tall guys were first row center. Songs she played, not in order: (I know I'll forget something, forgive me) Chopsticks, Cinco de Mayo, Flower, Johnny Sunshine, Johnny Feelgood, Polyester Bride, 6 1, Fuck and Run, two new songs - Firewalker and another one that really rocked but I don't know the name - something about falling out of bed/emotions/being dangerous, Supernova, whitechocolatespaceegg, Uncle Alvarez, and encore: Divorce Song and Perfect World. She kept screwing up the lyrics - for Johnny Sunshine and I don't remember - but another song. She even joked about it "You'd think I know the lyrics for my own songs." Which was really cute and funny. She made a comment about how it's her birthday in a few days, so I assume she's looking forward to it. Someone requested Carnivore and she said that it's really complicated and she can't remember how to play it. It was a really excellent show, well worth the 6 hours I drove to see it. =) Go see her if you have a chance. I was going to skip this tour 'cuz I've seen her so many times this year, but am really glad I went. Did anyone tape the show? I'd be happy to trade or send you something else Liz-related. That's not correct. Copyright exists from the moment something is created. Staking a _legal claim_ to that copyright requires tangible proof that you were the original owner AND that the infringement caused you monetary loss or other damages to your name, reputation, etc. That's a very general definition. Meaning IF Liz decides in the future to release the Girlysound demos, there could be grounds for suing anyone who booted them in the past, for diluting the market. There would obviously be little money in it suing informal fan CD and tape trees, but commercial CD bootleggers could get hit. Still, the money isn't there to make it worthwhile. Few artists have a broad enough appeal to make CDs of demos and outtakes worth selling through a major label. And the label would likely be the one to pursue the rights. Now if Liz wanted to set up her own shop to make some money off sales of Girlysounds, that would be a different story. Again, not enough money involved to sue amateur bootleggers, but the unethical quotient takes a steep upward turn, because copies would be available from an official source that would get money back to Liz. >Also, Ken didn't get sued Just because someone doesn't get sued now doesn't mean they can't get sued later. Copyright extends from the moment of creation to 50 or 75 years after the original owner's death (don't remember the exact number, and my media law book is buried in the garage). Suffice it to say, the Girlysound demos (what I've heard of them ... Combo Platter and Juvenalia) have such poor sound quality that its not marketable outside die-hard fan circles. That, in itself, makes those lawsuits highly unlikely. The wcse demos might be irritating to Liz, her management and/or Capitol reps, because the sound quality is much better (being done in a studio instead of Liz's bedroom), thus making them more likely candidates for b-sides or later albums. Obviously, the cuts that weren't used were considered inferior to the stuff that was released, so I don't see why they would care enough to take legal action. If they did, it would probably have to be against the guy who sold the tapes to Ken (and that guy only made $1250 off it, chump change in the music industry). The moral of the story is: Don't worry about it. April ------------------------------ End of support-system-digest V2 #110 ************************************
