Napster will remain in business for the near future after the three judges at the Ninth Circuit Court of Appeals in San Francisco did not come to an immediate decision surrounding the case, which is set to help define the boundaries for music file-sharing and distribution on the Internet. Representatives from both Napster and the Recording Industry Association of America (RIAA) appeared in court, appealing for and against a judge's earlier ruling in July that Napster are infringing on artists' copyright by providing their service. According to US reports, in court, Napster CEO Hank Barry suggested a compromise could be reached by charging a monthly subscription for the service - thereby providing funds for musicians. In a statement posted on Napster, www.napster.com, Barry said: "We strongly believe that members of the Napster community who share music on a person-to-person, non-commercial basis are not violating any law. "We will use every possible avenue to defend our position in court. However, I want to take a moment at this time to note our surprise that we have been unable to resolve this case outside of the judicial process... "Over a period of many months, Napster has made serious proposals to each of the major record companies and their publishing affiliates that involve payments of substantial percentages of expected company revenues to compensate artists and rights holders - proposals whose most conservative estimates would result in payments of over $500million to the industry in just the first year alone. Every one of these proposals has been rejected, and the record companies have made no counterproposals. "Just as we will continue to press our case in court and on Capitol Hill, we will continue to seek an agreement with the recording industry, because we believe that our 32million users deserve nothing less." Hilary Rosen, president and CEO of the RIAA, said, also in a statement: "Nobody expected a ruling from the bench today but we were pleased with the court's understanding of the issues. We hope the court will render a decision as promptly as possible." A written decision is expected from the judges in the near future. - ----- To unsub, mail majordomo@smoe.org with the message: unsubscribe seven-seas or unsubscribe seven-seas-digest to get off the digest And here we thought Mattel was happy just cutting Ken's nads off: http://anon.free.anonymizer.com/http://www.openpgp.net/censorship/index2.html ------------------------------ Date: Mon, 9 Oct 2000 13:26:02 +0100 From: "Rajesh Patel" Subject: seven-seas Holiday Moment So, I got back from a fantastic holiday in Bermuda yesterday. I thought the point of buying through the net was to get cd's cheaper because they do not have the over-heads of the large retail stores.... Yes I spose it's just teething problems but I have to agree with you on the price (reluctantly :-( ). >> The site is shit. Poorly constructed, vague, and full of bugs. I was willing to buy it both ways because I want the hard copy but didn't want to wait the seven days for it to arrive, and the download page was impossible to work out. It kept giving me a 'nothing to download' error, which I was guessing was related to the fact that the user name they gave me was longer than 16 characters. This really is quite an embarrasment for the guys running this site. Quite horrific. Has anyone heard all the tracks? Are they as spectacular as rumored? I'm willing to fork over the bucks, no prob, which is what makes all these technology barriers even more frustrating. Meaning, your browser must be pulling up an old saved version of the site. If you're using Internet Explorer browser, go to TOOLS, then INTERNET OPTIONS. Find the TEMPORARY INTERNET FILES category under GENERAL. Click the "Delete Files". Click OK. Then you're all set. For Netscape browser users: go to EDIT dropdown menu. Choose PREFERENCES. Then find the HISTORY heading. Click the "CLEAR HISTORY". You're all set. MACs? I haven't a clue. Frank is good with those... Good luck... Over all, it sounds like Will had a lot of fun. His imprint is on every track, from solid twang to spaced out blurps and blips. Track one: Hang Onto A Dream melancholy. I feel like maybe Lenny might like to cover this one. Very simple arrangement. a 5-star wrist-slasher Track two: Avalanche has a cool Velvet Underground vibe. the lines are classic Mac obscurity- Snowblind I can't see and I can't breathe, feeling So tired Turn the lights off when you leave then there's some falsetto "doo-doo"'s One impression I've gotten as a whole is like Mac had said-they've become a BAND. Track three: Zimbo a spacey, eerie re-make. completely a band effort, as is Track four: Silver good to hear Mac singing this one again Track five: Angels & Devils sounds a bit like it's been recorded in Nepal at the feet of the Dali Lama. Good to hear the return of the psychedelic vibe.
