There are too many American legal questions involving fair use doctrine, the responsibilities of an individual computer user, the responsibilities of an Internet Service Provider, the constitutionality of a 1999 bill that allows the RIAA to subpoena ISP records without having to have a criminal search warrant, and much, much, more. They cannot win these first cases, as they are sure to be appealed no matter the verdict, and it will take years to resolve these issues. However, since the Bush junta has already passed a sweeping Big Brother bill called "The Patriot Act," they could and probably will make even more severe laws of questionable constitutionality and allow prosecution under those laws until an injunction is granted by some sane judge. Since I live in the Fifth Circuit (infamous for being involved in Dead Man Walking), and I don't wanna be no dead man walking, my download days are over, and I am "legitimatising" my collection, hence the purchase of the back Radiohead catalog among others. _The Bends_ is a bastard no more, for example ;-) I have the cute little drawings and everything :-) However, recording the radio and the television are still legal acts, and since we have digital cable radio now, with no commercials..... so long as the radio stations do not pre-announce or display their upcoming tracks, they can play anything.
