The record labels sought to dismiss the suit under a California law intended to prevent the suppression of free speech. The companies claim that product labels and advertising, including any alleged failure to warn, are protected by the 1st Amendment. The suit filed last year by two consumers claimed that piracy-protection measures on CDs sold by the major labels make the discs "unreproducible or unstable" for use in many PCs and DVD players. The appointment was reported Friday morning on The New York Times' Web site, and an official announcement is expected shortly. Mr. Lack, 55, has been engaged in a power struggle with NBC Chairman Bob Wright, and speculation that he would leave the company has been rife. NBC isn't planning to fill his position. Mr. Lack spent 17 years at CBS before joining NBC in 1993, and has no experience in the music business. He is expected to lead a financial housecleaning at Sonys troubled division, which has lost $132 million so far in the current fiscal year.
