I'm NOT making any moral judgements here, it's purely the legal aspect. Bootlegs on Ebay are no more or less legal than bootlegs duplicated by a CD tree. CD Trees may not provide profit for the distributers (whereas Ebay can), but they do not produce legitimate, authorised copies. The only people who can make and distribute authorised copies are the record label/Management, or people authorised by them. Thus, stuff on Kevin's UK Site (and Alison's US one? Don't know if the soundboard recordings are available there, I haven't been there for a while) which was recorded from the soundboard and distributed with the permission of the record company/Management is a legitimate copy - for the specific purpose of mounting on the website. Further permission would be required to distribute these further/copy to CDs etc. and since Kevin was the only person given permission to record and make available (as far as I know), he would be pretty dumb to make them more widely available because it would be instantly traceable to him. However, recordings made by enterprising people in the audience are not legal copies (because they didn't obtain permission first) and never can be unless the Record Company/Management give retrospective permission for their existance and distribution. The exchange of money for copies has nothing to do with legitimising copies, it simply reduces/increases any possible claim for damages from Record companies/Management (they could claim against income recieved from the illegal copies, so if there's no income and no equivalent legal copy whose sales are being affected, there's less chance of any action being taken) Boring legal stuff over.
