I was at the Rocky Mountain Folks Fest with some friends and family and towards the end of Patty's set, my aunt turned to me and asked, "Why is she doing all these Dixie Chicks songs?" I immediately set her straight on that and I think she felt a little silly (since I was was so obviously offended by the question). But that will happen.... Just for the record though, I love the Dixie Chicks and think its great that they did the songs. In this case, the appropriate performance rights organization responsible for tracking this sort of thing (i.e ASCAP, BMI, and SESAC) usually receive a set list from either the promoter, the artist, or from others that are aware of what was performed. For any significant acts (i.e. you're buying your tickets through a ticketing service), this is generally not a problem. Obviously, minor acts performing at your local pub might neglect to report their use of copyrighted material. Sort of like copying commercial CDs rather than pay the artist and with the same sort of rationalizations.....
