What they were sued over is the fact that the batteries aren't (trivially) user-replaceable, which, though a valid criticism, is also pretty obviously a conscious design decision (i.e. no ugly battery door / latch to mar the uber-obsessive design, etc.) Power consumption is the Achilles heel of all portable electronics, really -- batteries, at a fundamental level, haven't changed all that much in 100 years. It was definitely a frustration with my old third-gen iPod, which had problems with random battery drain, but it seems like it's a problem they've fixed: I got one of the new 160GB iPod Classics a few months back and I swear it's never even dropped under 3/4s charged even if I go a couple weeks between charges. Charity's clip-on Shuffle needs to be charged, like, once every 4-6 weeks. My brother worked for years on the hydrogen fuel cell for GM as an engineer at a company called Quantum Technologies. It took a lot of labor and late nights to get the first working prototype. Now if they can get the technology where it's at a cost that is reasonable for the masses. They're graduating from the "gee whiz" stage at auto shows to actual cars for sale by GM, I think in 2009, but they will be quite expensive. Hybrids are getting there, but they are still pricey (but think how far we've come since that first Honda 2-seater that looks like a relic now), and it's still cheaper cost-per-mile to drive a conventional 4 cylinder. I don't think there's even a 3-cylinder for sale in the US at the moment (I've had two cars with them--love 'em). That little smart car has one, but it hasn't made a debut as of yet, and I think that's only going to be marketed in big cities. I think it hits later this year. I read VW is going to bring out a turbocharged 3-cylinder in a new model. They have a new company president who wants to take the company back to its roots and reestablish itself as a people's car again.
