The bass riff from "Come As You Are" is identical to Killing Joke's "Eighties" ( a brilliant song, BTW). Killing Joke considered suing, but.... cut & paste from web rumor board: The songs were so similar that Nirvana considered holding off releasing this as a single. Killing Joke decided not to sue Nirvana, and in 1992, Dave Grohl helped them out by playing drums for them on an album. (thanks, Jacq - Sydney, Australia) I think a lot of it depends on how deep the pockets are on both sides for legal fees. I'm sure a big part of the reason George Harrison got sued for My Sweet Lord was because, well, he was George Harrison, and he can afford it.
