ASCAP is the biggest of three American P.R.Os (Performing Rights Organizations) that exist to collect and distribute the royalties due to their member composers/songwriters, authors and publishers. Since there is no union for the songwriting "industry" we need some sort of collective bargaining apparatus to represent our rights and ASCAP occupies that role, and very well too. It has 350,000 members at present and grows every month. In that capacity it also functions as a non-profit grassroots lobbying arm for us. At present, traditional models of "performance" via TV and radio are being supplanted by the internet and more and more people are getting their music, TV shows and films by downloading them to their hard drives. As a consumer I love this, as I'm sure we all do. The problem is that the law protecting the composer's royalties do not extend to downloads. For example, if you write a song that is included in a movie or TV show you get a small upfront fee to write it, out of which you nowadays have to pay for all musician and recording costs, leaving you with what remains. What you depend on for your living is the "back end"; royalties that come to you each time the movie "performs" your song via broadcast or cable, pay-per-view. Those rights are secured. BUT the minute that movie is available as a download via Amazon, iTunes etc, not one cent is owed to the composer due to the laws being behind the technology curve. And many movies these days bypass the theaters and go straight to DVD and virtual DVD. So more and more people will be downloading their movies TV shows as broadband speeds increase and hard drive space becomes a non- issue (1Terabyte hard drives for $99 now!) As you can see, the issue takes a little explaining, and so it did before members of congress and the senate. We are trying to have the performance royalty be secure no matter what means of transmission the work is received through. So ASCAP put on a lavish gala concert Tuesday night at the Library of Congress before the Washington powerful (Nancy Pelosi, Barbara Boxer, Lamar Alexander, John Glenn etc etc) featuring the writers of dozens of hits that their generation grew up with. Ashford and Simpson did two of their Motown hits including "Ain't no Mountain High Enough", Hal David did "Raindrops keep falling on my head", Don Schlitz did "The Gambler", Jimmy Webb did "Wichita Lineman", Monica Mancini did a couple of her father's classics (Moon River and The Days of Wine and Roses), Johnny Mandel did "The Shadow of your Smile" and the theme from MASH, etc etc. It worked like a charm; the members of congress were not only at a concert of songs they all knew by heart but the point that each of these songs were written by the person in front of them, who depended on royalties for their living was driven home. So instead of songs just magically appearing from the ether it was clear that someone has to apply a lifetime of craft to make them. The next day we had meetings back to back with House representatives and senators, many of whom had been at the show the night before. They were falling over themselves like kids getting Babe Ruth's autograph to be meeting the people who had written the hits for Sinatra and Tony Bennett along with regular schmo songwriters toiling in the trenches (which is why I and 19 other "constituents" were flown in to town to augment the advocacy groups). Wednesday night ended the events with a dinner at the Four Seasons for all the performers and all of us "lobbyists". At my table sat Marilyn and Alan Bergman (heads of ASCAP for the past 20 years and composers of Windmills of Your Mind, What are you doing the rest of your life?, A Whole New World and dozens of others), Jimmy Webb ("Wichita Lineman") The head of Universal publishing (the biggest music publisher in the world), Monica Mancini (vocalist and daughter of the late Henry Mancini--"Moon River", Pink Panther") and a nice singer songwriter in her early sixties who introduced herself as Kate Taylor (by the end of the evening the penny dropped and I realized she was James Taylor's sister. Earlier we had been talking about guitar fingernails and acrylics in particular and she said her brother (no mention yet) played using them and got a nice warm tone--- ah-- yeah he does!). So basically I'm in amongst the leading lights of 1960's era American songwriters, listening to a speech by the US Trade Representative telling us that President Obama views creators of intellectual property as America's finest asset and finest export and that we and our rights must be protected. I came away jazzed at the message and the august company I had just sat with and rather buzzed from the bottomless wine glass that kept being refilled in front of me. I also came away with a better understanding of ASCAP and the wheels of government, and an increased respect for both. Joni of course came up in conversation with my colleagues many times as probably the finest of all 1960's era songwriters, and she might have been there herself of it weren't for the fact that she's with BMI, the other P.R.O.
