Apologies if I did. I'm surviving some senior moments already at 48 years old. I heard recently that there's some new law in Canada, taking away property rights from songwriters. What I heard was a rumor that said unrestricted downloading is okay in Canada. The next week the Cowboy Junkies sent an email to their fan base saying a new album is complete and will be released this year. I gulped. At work, I discussed this with one of my co-workers and my boss. I said, "I hope the Junkies hold up the album until that law is overturned." My boss said, "Why? Don't you want some free music?" This is a guy who has a 3 acre estate, 2 living rooms, 2 kitchens, etc, etc. I said, "David, after they put their creativity and work into a new set of songs, they should be rewarded. If they release a new album now, it might become the one album in their catalog which everyone steals. I wouldn't steal it, but the timing is terrible for them." True to his status a survivor of 3 strokes, he came back with, "But Jim, they can always tour." David is a Dead-head so if Jerry did Okay on income derived solely from live performance, it must be good enough for everyone else too, right? I began to ask him if he knew what "intellectual property rights" are but by then we were interrupted (as usual) and the conversation never got back on point. It's not legal - it just isn't *illegal*. Capisce? Apparently uploading and making files available for sharing is illegal, whereas downloading is not. You are allowed to make personal copies of CDs (if you have an Ipod, or an mp3 player, or you copy onto your PC and burn a CDR as an extra, for example). A levy is charged to consumers on items such as audio tapes and CDRs that is supposed to go into a pool that pays musicians for loss of revenue - how exactly they determine what to pay to whom is a mystery to me. The Canadian Recording Industry Association (CRIA)wants internet service providers to provide names of some song uploaders, presumably a group of heavy users. The ISPs have refused to provide the information on the basis that privacy legislation protects these people's identities. A federal judge ruled on mar 31 that the CRIA has no legal entitlement to these people's identities. The CRIA has filed an appeal. Maybe I'm being overly optimistic, but I honestly don't think it's going to change anything (much). I don't think Canadians are any more or less likely to download music than anyone anywhere else. Those who download (illegally) probably still will, hoping to beat the odds of being caught. As far as I know, it's only the really big downloaders/uploaders and filesharers that the FBI et al are going after. The real fans will still buy the albums. Somehow I *knew* this request was coming. Okay, the venue was the 3rd floor of a building from 1890. The room was the right size for 200 people and it looks a little like Saturday Night Live. Like I said, it was SRO when I got there but I ended up with a bar stool as the opening songwriter finished. 20 minutes later, suddenly, out of no where, there's a 50 something woman with a 6 string, directly in front of me. Fidgeting. Unannounced, she strode purposefully to the stage, climbed both steps and fidgeted some more. She waited for the greeting to die down and said, "Hello. Wow, I never expected a big crowd like this in Covington, Kentucky! I'm glad you are here. Uhm... It's kinda bright up here. Could we turn the lights down some?" Nervous laughter in the audience. "Thanks.... Listen, I'll probably be taking my glasses on an off a lot, okay? Sometimes it's kinda hard to get comfortable." Empathic laughter in the audience. She put her bifocals on a stool. "No, now I want them ON!" Genuine laughter in the audience. "Okay. Uhmm. Could we turn down the lights some more?" Much more laughter in the audience. Now the light level on stage was only a little bit brighter than in the audience. (I remember thinking I could have captured details in both groups on one frame of film. I was sure she could see faces in the crowd at this point.) "That's MUCH better. Thanks. Listen, this is the last night of the tour..." She talked about being 52 and about her big hair. She totally put the crowd at ease, the way a pro does, as if to say, "You can relax. We're gonna have a great evening." Along the way, she mentioned feeling hurt when her husband filed for divorce. I remember she did her radio hit about her new partner. Ya know the one where she's saying I must have done something pretty good to be rewarded with someone so special. It was sweet. After the applause died off she wondered what her woman friend must have done "so wrong" to deserve a partner who's on the road all the time. She strummed the guitar, and said, "So I wrote a couple of verses from what I imagine is her point of view." In short, she parodied her own hit. "I'm musta been Hitler / Stalin / someone like that." It was funny. But Ashara, you asked about the new songs. Have you heard "The Potato Song", a silly novelty? When she came off the road, one day was out on a long walk with her dog. She found herself inexplicably fixated about potatoes. And the "Mexican Hat Dance". Both, simultaneously. She decided to put potato lyrics to "The Mexican Hat Dance", as a songwriting exercise. "It turned out to be a LONG walk." The verses, as you would imagine, are about the various ways the potatoe Serves Mankind. The chorus was the tricky part because it initially ended: Cheryl Wheeler sang to the Mexican Hat Dance: > po-TA-to / po-TA-to / po-TA-to / po-ta which was all well and good except it ended in the middle of the title object: > po-TA She found it unsettling to end the chorus in the middle of the word like that. (Laughter in the crowd, obviously). She decided that in order to show the proper respect for the potatoe, she should always use the sylablles in order but the chorus must end on the proper syllable. She presented the final version. In the interest of time, I'll include only the appropriate couplet. > po-TA-toe / po-TA-toe / po-TA > to / po-ta-toe / po-TA-toe / po-TA-toe > po-TA-toe / po-TA-toe / po-TA-toe. Splitting the word across lines there was clearly the key. Like Nellie McKay and Louden Wainwright III, she's a nut. Here's the last story I remember: She said when she was growing up, her parents played spirituals on the Victrola. When her father passed, she felt inspired to write one about the childhood that she and her sister shared under his roof. I don't remember the title but it is a fine song, with enough detail to show it came from a real experience but it also has enough universal language that everyone was able to see themselves in it. It appeared to be complete in every way. It was quite remarkable and she earned the evening's only standing ovation. After the song, she asked people to raise their hand if they recognized the lines from the spiritual. 6 or 7 hands went up and she kinda swooned. She said something like, "Oh, that's good. I was hoping it would be familiar to some people. That's great." It was important to her that others shared that heritage. I was clear to me that a) she's a fine performer, easily worthy of my money next time, b.) she loves to create a give-and-take with her audience c) she's funny and d) on her best day, can write a fine song.
