First of all, Bootlegging is illegal, is it not? Even if the fair Jewel agreed to have her shows recorded, most venues dont allow it, so I'm sure we'd be violating some kind of copyright law... Second of all, how many people have the kind of internet connection required to swap 600 or 700 meg .wav files? If someone suggests .mp3 I might get a little upset... that's a nice idea and all, but if we were going to put seroius resources into this idea I think we'd have to take the high road and go .wav... I know that I personally wouldnt be particularly interested in trading MP3s, knowing that there's a higher quality recording available - because that's what we're really looking for, a high quality sound. Anyway, if I'm wrong about bootlegging someone let me know... Venues will allow it if the band says its ok. If Jewel would allow taping of her concerts, it would be totally legal to trade them as long as no one made any money off of them. If anyone wants info on taping/trading, start with www.etree.org and www.furthurnet.org . The second is where you can download Furthur software, which is just like napster, except is limited to live recordings of bands with an open taping policy. As for the files, there is a format called .SHN that is lossless, but still reduces the file size considerably. Most full shows end up being about 800 megs, which is alot, but not too much with a fast connection, and it is a really good way to get good shows. And, depending on the recording, the shows usually sound great. There is a program called mkwACT that you can download from the etree site that converts .wavs to .shn and back. So if we can just get Jewel to open up her taping policy, then we could get her on Furthur's list and we could all start sharing our angelfood. The recent discussion of trading audio files via an FTP site cannot be condoned on this list and I must ask that discussion of such on this list stop now. I have avoided posting about this topic for quite a while now, but it appears I can no longer do so. So, to help you understand, I will have to totally spell it out for you by telling you of a somewhat recent occurrence off-list due to something that was was taking place on-list. Atlantic Records and the RIAA are monitoring this list and have been for quite a long time, probably since before I took over the list in the summer of 1997. There are certain things they are "looking for'" and the present topic is definitely one of them. They WILL take action on this, trust me, I know. I have spoken on the phone with representatives of the RIAA in the past and I know what they look for and what they will go after. If you use your common sense, it is not too hard to figure out that this proposed FTP site is one of them. Last summer (2001), a list member who shall remain nameless got into a lot of legal hot water and was pretty close to being arrested for maintaining a website with a large number of "non-released material" Jewel MP3s on it. Atlantic Records and the RIAA caught wind of it from monitoring this list. They did want to press charges, luckily however various things prevented that from happening and the site was taken down . I have been trying to keep a close eye on anything similar occurring on this list ever since. Twice since then I have telephoned list members telling them why I thought what they were about to do on-list was a bad idea. This proposed FTP site falls into the same category. In addition to any such site maintainer facing legal hassles, this list's owner (me) and smoe.org can be brought up on charges for allowing such copyright infringements of this and a similar nature to occur. I have seen some lists shut down for condoning such things, although it has been a while (I mean a while since I have seen it first hand...I am sure it still happens here and there). It's the luck of the draw. Just depends on what business entity is watching what list. So, again, I must ask that discussion of such a site, and/or the offering of MANY Jewel audio files via a site you maintain or know of, come to an end. I do not want to see anyone here get into legal trouble and I most assuredly do not want legal problems myself, *nor the very existence of this list to fall into peril*. We've been around to long to endanger it now. Keep in mind, it IS alright to talk about and offer up a file here and there as many of you have in the 18+ months since I've allowed MP3 and similar files on this list, it's just that when it goes into high gear and "mass production" that it gains the attention of the RIAA and Atlantic Records. What has been going on here the last 18 months (up until now) is "small potatoes". Just use common sense and realize that the record companies DO mean business. I've seen the nasty end of it.
