The problem is, what he wanted to do WAS commercial copying... by noncommercial copying they mean copying it for yourself once you've purchased the album. He would have been offering it to other people, and while no money besides cd and postage costs would have exchanged hands, I'm pretty sure that would still be classified as "commercial", simply because those people weren't paying the artists or the recording industry for it (and you know how dumb the recording industry can be about losing a little money!) ~ Sandy ------------------------------ Date: Tue, 27 Mar 2001 10:01:49 -0600 From: "Karacostas, Derrick W." Over 4 >years of wanting to ask that question... No, it's not bad to ask...and there was no reason to wait or be afraid to ask for over 4 years. (I still get 3 or 4 inquiries about it a year) The answer though is, simply, even though I adminstered the JewelStock Tapes tree (3 tape set), the decision about treeing JewelStock Tape #4 is not mine to make. It never was and never will be. (unless of course Jewel FINALLY agrees to hire me as her manager...lord knows I sent in enough applications.....just kidding ;-) Personally, I do not feel we'll ever see that day (that we'll have permission to tree JS tape 4), but we can always keep hoping. [Yeah, yeah, Berne convention, blah blah blah. :-) ] But what does that have to do with this particular case? ANYONE offering anything on this list that goes against the copyright infringement policies the RIAA wishes to pursue falls under their juristiction as the list is owned and operated on United States soil. That's pretty much an end of argument there. Since this list runs on a server in Boston, even Joe in Australia cannot offer all the EDAs in Australia CD-Rs of Atz & Nedra or POY or Spirit. I am not sure exactly what would happen with the Aussiies if I allowed such a thing to occur and never step in, but I DO know this list and/or smoe.org would certainly face some consequences in such a case and the RIAA was aware of it. The RIAA has in the recent past shut down mailing lists and of course many web sites (as many of use have seen). Paul further replied: >(b) It's not worth the $500 an hour they pay their lawyer to chase some >13-year-old kid in Walla Walla, Washington, when no money is changing >hands. Can't argue that one. Yeah, but non-commercial pretty much ONLY covers personal use. In the case in point here, the offering of copies of Nedra & Atz's albums, even at even trade or cost incurred IS commercial. Look up commerce in the dictionary and most definitions mention "exchange OR buying & selling". Now, I know many of you may be wondering then "how in the hell can we ever offer ANYTHING? How have we been allowed to offer Angelfood and/or the Future Folklore tapes in the past?" Simply.....what we HAVE been offering fell under one or both of the following categorties: 1) the artist and/or their management approved it(and in a few cases supplied it) 2) it was an item the RIAA and/or Atlantic Records are not on the warpath about (i.e. copies of material that was broadcast for free on the radio and NEVER was for sale, material recorded by an audience member, non-album stuff that was on a promo CD/tape, stuff falling into category #1 etc.) So, what it all boils down to is that nobody can offer stuff that once was or presently is for sale legally. I wish I could go deeper into this topic, but I just got home and it's been a looooooong day, and there's a couple of other posts I have to reply about. While I am sure most of us EDAs and especially the folks from the JewelStock era would agree with Derricks wish (as do I), I have a feeling we'll never see that day. This is simply because while at that time the JewelStock performances were quite arguably the pinnacle of her shows up to that time, there have been recorded performances since then that surpass the video quality that was recorded at JewelStock. (i.e. they would probably choose one of those over JewelStock). Also, and perhaps most importantly, the audio tracks recorded on the video tapes are not what was recorded by the Bearsville Studios sound truck nor even what was on the JewelStock tapes, they were recorded via the video-cameras built-in microphone(s). So it would take a LOT of time & work to accurately synch the Bearsville Studios audio and SkinnyPete's (remember him?) and his crew's video. It was probably easy for them (J-team) to synch up the sound for whatever clips we'll see on Jewel's website, but the task of doing either one or both JewelStock shows in their entirety would be monumental. Thus it's more likely we'd see some other concert(s) made available on video tape. (if that were to happen) Mike :-) ------------------------------ Date: Tue, 27 Mar 2001 20:48:08 -0500 From: Lucas Holt Subject: Re: [EDA] NJC: Atz & Nedra albums I don't think anyone wants to get Mike or smoe.org in trouble over this.
