In particular the part where she goes "in case you failed to > notice", and I was wondering if 1. This is legal, or if she gets some kind > of payment or acknowledgement. and 2. if Fastball are Jewel fans. AS regards #1 there... copyright laws are bizarre, and very difficult to interpret when it comes to sampling, or incorporating bits of other people's songs into a new composition. This is because the laws were written before the technology existed... But with a major label act like Fastball, there's no chance that they're using that sample uncleared. If they're on Atlantic, then it's all smooth, but if they're on a different label from Jewel, then whoever owns the publishing rights to Foolish Games probably picked up about... 15,000 dollars or so. Actually, considering the popularity of the song, more like 50,000. UNLESS, that is, Jewel personally retains the legal rights to her music and lyrics. That's not at all common in today's music industry, but if it's the case then it's entirely possible that she just let them use it for free. Artists are generally a lot more reasonable about these things than lawyers. I will never pay to clear a sample. | Jesse Dangerously http://www.chebucto.ns.ca/~ad309 | subterranean seraph 16 Trust Everyone | ad309@chebucto.ns.ca Ekam Sat, Viprah Bahudha Vadanti | ------------------------------ Date: Mon, 14 Sep 1998 19:14:09 EDT From: STAC5984@aol.com Subject: Jewel Performance I was watching the CBS sunday morning interview that I taped, and I just wanted to know: What performance is it that they show footage of. Hi Angels! OK, I just remembered this thing on the channel 10 news (in San Diego) after the Oprah show w/ Jewel. They were showing the commercial for the segment throughout the Oprah show, saying they wanted to introduce a singer who was just like Jewel. Well, I was curious so I watched the segment. It was this woman, in her 30's, singing this gorgeous song. And she had this beautiful guitar with mother of pearl details. Well, let's see, she was blonde....that's all I remember. I know, I'm so specific! Well, if any SD EDAs caught that show (it was hard to miss because they mentioned Jewel so many times in the commercials for it), I was wondering what her name was. They said she played the coffeehouse scene here, and I don't go to those so I didn't think to remember her name, but now I am really curious! She was really good, and she really did sound like Jewel! So if anyone knows who that was, please email me, privately and/or to the list, it doesn't matter. Thanks! Although previously reported as retitled to "The More I Live" it has now been officially changed to "What's Simple Is True". Just when you updated all your tape labels... ;-) You'll all be very happy to know that Jewel's new album is essentially finished & in post-recording production. The official title will be posted soon. It's got a lot more depth to her writing (than POY) & is very spiritually (without being religiously) focused. Sparsley arranged for the most part, it really highlights Jewel's amazing voice & bridges her poetry & music much more successfully than her 1st album. I know most EDAs are gonna be blissfully blown away! :-) Release date is still scheduled for Tuesday, November 17th, 1998. Also for all those writing me for tour dates, I haven't any confirmed dates yet. I will definately post all that November (& possibly December) touring info as soon as accurate info is available. Hang in there! It won't be long now. :-) Many are writing me asking about some song by "Fastball" that includes a sample of "Foolish Games". I really don't know anything about this band so I can't help ya there. Perhaps THEY have a mailing list. That would be a better place to find the answers to all those kinds of questions. Maybe you can research your own questions on this & report back to everyone who's curious about it? And if you are in the Eastern USA & attended, please post about your LRT gig experiences or write me privately if you attended. I'm very interested in your thoughts about these wonderful shows. Big Congratulations to Duff for being a talented LRT Co-ordinator! And huge thanks to hosts Greg, Liz, Dennis F, Gerry L, Dennis H(Jerry & Jim), Stephanie, Eric, Hilary, Mykle, Erin, Duff & AmyJo's family for opening up their homes to so many! Incredible hospitality from all of them & a great job throughout the 1998 LRT with Joy Eden Harrison, Lisa Sanders & an evergrowing cast of EDAs. I know Joy & Lisa loved the experience & many of you now totally understand why many of us have been raving about how wonderful these talented women are! Finally :) Hey people - Sorry for the delay in reporting all the details of my Richmond,VA LRT . In short, it was simply amazing . . . big surprise. Not only did I get to see my good friend Lisa again , but was also lucky enough to see Joy Eden Harrison for the first time ! Wow . While it seemed as if things were going to go awry at first when I could not get in touch w/ Lisa and Joy at their hotel b/c of an evil receptionist , all worked out ! Yayyyyyyyy . After rearranging my living room and waiting on some late comers , Lisa launched into her first set completely amazing everyone in the room . Then, Joy took the floor to blow us away . During the break , cds were sold and conversations were had , etc. Then , the second part of the evening began . For some reason , the second half (or in most cases encores) of all shows bums me out b/c you know it's almost over . At any rate , Lisa did a few new songs including one she wrote for a Val Kilmer/Mira Sorvino movie (whether it will be used or not is to be decided) and even an acapella version of "Lazy Days". Joy amused everyone by doing "Goddamn Cowboy" and attempting to write a song w/ all of us . Needless to say , it was a disaster as everyone was lost for words . It ended up as some country song about cows . . . or something . Perhaps the most enticing part of the night was Joy's spoken word piece which can be found on the limited edition tape available at the shows. The performance cannot even be justified with words . . . definitely something to experience for yourself . Finally , the evening came to a close with many a new fan of both Joy and Lisa leaving my house . Many folks who came out had not heard one or both of the ladies before . So, it's always wonderful to introduce anyone to such talented artists . After the show , I took Lisa and Joy to my favorite watering hole / 24/7 diner in Richmond where we toasted the LRT and talked until the wee hours of the morning . With a long drive to North Carolina the next day for Joy and Lisa and work for me , it wasn't really a swell idea to stay out that late. . . . but what the hell . . . it's all in the name of the LRT :-) Woo hoo ! Cheers ! Hil ------------------------------ End of jewel-digest V3 #486 ***************************
