My 2 cents on Jewel being overexposed is different than most people who have been posting lately. I think we have a slightly distorted viewpoint. Before joining this list I had found ONE measly magazine that mentioned Jewel, and I had to look it up on microfilm in the library. Because we make each other aware, we know every single Jewel appearance in print, but to the "casual" magazine reader, Jewel would appear much less frequently. I found myself in the last 2 weeks buying upwards of 10 magazine, many of which I did not know existed. On my own, I would mave seen Time and Interview. Nothing else. And the non-Jewel fan would not have picked up the Interview. Now, I don't look at magazines often, or sucscribe to any, but IMHO, Jewel's overexposure is different to those who don't seek to be exposed. Lured by the chance to mix business with some time in the Florida sun, 11 European and American record distributors traveled to Orlando in March. They were invited by a local distributor, who told them he was prepared to pay back some IOUs during their stay. What the visitors didn't know was who really was behind the invitation: the U.S. Customs Service, acting at the urging of U.S. recording companies. Sweeping into hotel rooms one by one, federal agents arrested the visitors. The 10 men and one woman were charged with a total of 40 counts involving a conspiracy to make and sell "bootlegs" -- compact discs of music that has never been officially released, such as secretly recorded concerts and outtakes culled from studio sessions. The Orlando sting was the climax of an undercover investigation by Customs called Operation Goldmine. The year-long investigation yielded a mother lode. When agents finished raiding warehouses in the Orlando area, they turned up 800,000 compact discs containing unauthorized recordings of performances by the Grateful Dead, Dave Matthews Band, Bruce Springsteen, Phish, Smashing Pumpkins and dozens of other musicians. In the wake of the arrests, local record stores that carry bootlegs said supplies have dwindled. Scarcity, in turn, has driven up prices of the remaining discs, transforming $20 CDs into $50 CDs in a matter of weeks. "This has caused a lot of trouble," a Northern Virginia music retailer said. "It's difficult to get them anywhere now. The big [bootleggers] with the best quality CDs are pretty much out of business." This retailer, one among many owners of small record stores that sell bootlegs, said he has been threatened with legal action and requested that his name and store not be disclosed. The paucity of bootlegs is sweet music to the legitimate recording industry, which has tried for years to stamp out any recording released without official consent. "We're ecstatic," said Frank Creighton, an associate director of anti-piracy efforts for the Recording Industry Association of America (RIAA), the Washington-based trade group that prompted Operation Goldmine. "The shelves are clean of material." Bootlegs occupy a different niche in the music world, both artistically and commercially, from pirated material. While both are illegal, piracy typically means making and selling duplicates of legitimate releases -- an activity that costs big record companies like Sony Corp. and Warner Bros. an estimated $300 million in lost sales last year. Bootlegs, on the other hand, are recordings that the musician's official label has never released. There are no official estimates of the size of the bootleg business, though some observers guess that sales were easily in the millions of units last year. Rather than hurting legitimate record sales, some people argue, "boots" actually help them by keeping fan interest alive in the months or years between authorized releases. "The people who buy bootlegs are the kind of people who have everything ever put out by the artist and still want more," said Bill Glahn, editor of Live! Music Review, a monthly magazine that covers bootlegs. "Bootleg buyers are the people who are first in line when a new [authorized] album comes out." Bootlegs used to mean scratchy, almost inaudible sound. During the 1960s rock era, surreptitiously recorded concerts of the Rolling Stones, Bob Dylan, the Beatles and others circulated among hard-core fans and early collectors, giving bootlegs a romantic underground appeal. Some groups, such as the Grateful Dead, even encouraged "Deadheads" to record and share tapes of the group's concert performances, though the Grateful Dead and others discouraged selling these recordings. With the dawn of digital recording technology, bootlegs began to grow up. Small, high-quality tape machines have made it possible to secretly capture a concert performance with near professional audio quality. Many bootlegs, in fact, are recorded off the master soundboard at concerts, ensuring top fidelity. With artful packaging, it's next to impossible for a casual fan to tell a bootleg from an authorized release, said Pete Howard, publisher of Ice magazine, a music newsletter. Operating in the absence of strict copyright laws, European-based labels with names such as Oxygen, Moonraker and Kiss the Stone in recent years have pumped out CDs featuring popular entertainers such as Pearl Jam, Nirvana, Tori Amos and many others. "There is a small worldwide [group] of bootleg CD manufacturers and distributors," Assistant U.S. Attorney Brian Phillips alleged in legal documents connected with Operation Goldmine. "Live imports," as bootlegs often are euphemistically called, have been openly marketed over the Internet, at record shows and small independent record shops, and through ads placed in collector publications. The Orlando sting took its name from Goldmine magazine, a biweekly whose pages are crammed with ads for "rare" recordings of performers ranging from AC/DC to Frank Zappa. The magazine disclaims "responsibility for transactions involving unauthorized product." Selling or distributing bootlegs is now a felony, but until recently there were no federal criminal statutes against it. Although many states had anti-bootlegging laws, these were infrequently enforced, the RIAA said. The big legal change came in late 1994 with the ratification of the Uruguay Round of the General Agreement on Tariffs and Trade by the United States and 119 other countries. The treaty, which protects "performance rights," enabled the United states to coordinate anti-piracy efforts with other countries, such as Germany and Italy, where bootlegging had flourished. "Clearly, it's correct to say that a bootleg doesn't displace a legitimate sale," the RIAA's Creighton said. "But record companies have the right to decide when and how and to whom they are going to market their product. A live [bootleg] recording of Guns 'N' Roses from the Nassau Coliseum prevents our companies from releasing a version of that recording." Performers and their record labels, he said, own the rights to their work. The year-long Florida investigation was set in motion in early 1996 when RIAA officials tipped Customs officers about Thomas Fu-Lu Cheng, an Orlando record retailer. Cheng, according to a government affidavit, had been making inquiries in the Orlando area, seeking help in importing bootleg CDs. Posing as an importer, Customs agent Timothy J. Nelson contacted Cheng and agreed to act as his middleman; two other agents posed as a freight forwarder and customs broker. Their first deal was the importation of 7,000 bootlegs from Kiss the Stone, a label based in San Marino, Italy, the government said. Cheng allegedly shipped the bootlegs to his brother, Stephen Fu-An Cheng, who lives in California, for distribution to record stores in the United States. By mid-December of last year, the agents concluded they had enough for a case. Thomas and Stephen Cheng, along with three associates, were arrested and charged with illegally importing and distributing in excess of 100,000 bootleg CDs. But bigger fish were still to come. With the cooperation of the Chengs, the agents continued to orchestrate the importation and distribution of hundreds of thousands of bootlegs from a network of sources operating out of Germany, Italy, Switzerland, the Netherlands, Luxembourg, San Marino, Las Vegas and Beverly Hills, Calif. In March, the Customs officials sprung their trap. Thirteen of the alleged manufacturers and domestic distributors were invited to Orlando, on the pretext of collecting money owed them by Stephen Cheng. On March 13 and 14, the government made a nearly clean sweep: 11 of the 13 suspects were arrested without incident and charged with illegally manufacturing, smuggling or distributing bootlegs. Two of those indicted, both residents of San Marino, never came to Florida and remain at large, the U.S. attorneys office said. Eight of the defendants have pleaded guilty to smuggling or bootlegging charges and face up to 25 years in prison. Three others are contesting the charges and awaiting trial. David Chesnoff, an attorney for one of the defendants, Ali Moghadam of Las Vegas, predicted that they would be acquitted. "The government has no case. It is based on some unscrupulous informant." Efforts to contact attorneys for the other defendants were unsuccessful. While he is allegedly the pivot man in the whole case, Thomas Cheng hardly seems to have grown rich from his bootlegging activities. Customs agents said in court documents that Cheng drove a 1988 Toyota Corolla, and was so broke that at one point he had to ask the undercover investigators for rent and utility money. Thomas Cheng, who is in his mid-twenties, has not been formally charged and continues to cooperate with the government, said his attorney, Stephen Milbrath. "My client is still a kid, and in my view a naive kid," Milbrath said. "He's a kid who got in with the wrong group of people." As for the bootleg business, "time will tell just how profound an effect" Operation Goldmine will have, Ice magazine's Howard said. Because it's a holiday, accomodations on the island will be filled up earlier than usual so the sooner you can all let me know your plans, the easier it'll be to find lodgings or make some arrangements to make everyone happy. The tree-house mentioned in previous posts will be the artists' quarters to give Cindy Lee and Elizabeth a bird's eye view of the world of EDAs. There's still room in the Indian tipis (tepees) but those spots are likely to go fast. There are accomodations nearby to suit all tastes and budgets (from camping to cabins to inns). There's room for some people to stay where I live on farmland, but it's sounding more and more like there's going to be a lot of people here, so it's best to decide how comfortable you want to be and let me know so we can coordinate things soon! Depending upon the final body count, it looks like a contribution of US $10 or CDN $14 from attendees make it all happen. (If there's extra ferry boat, or other costs, it should mean only a few dollars more contributed by each of us.) Salt Spring Island is located in Canada's Gulf Islands, just north of the U.S. San Juan Islands (off the coast of Seattle, Washington), midway between the two British Columbia cities of Vancouver, on the mainland, and Victoria on Vancouver Island. When the Living Room Tour hits the Pacific Northwest, it'll be Indian Summer -- when the island temperatures are mildest, the sunsets most colourful, the evenings long and the night sky filled with constellations that circle round the Jewel of the North star. I'll post more travel and accomodations details closer to the date, and also privately to anyone who has specific requests or questions, but please let me know if you're planning to attend the August 29 Living Room Tour date during Indian Summerstock so we can organize everything (rides, carpools, boat schedules, accomodation, contributions/expenses etc. for the artists etc. etc.) ASAP. As well as a rare opportunity to get together in a beautiful, natural, surrounding and enjoy the music of Cindy Lee Berryhill and Elizabeth Hummel, there's beaches, hiking, plenty of wildlife, an artists' market and lots of other things to experience on Salt Spring, Canada's arts and crafts island. First of all, for those of you who are upset because of the credits at the end of the new FG video where they say: Music from and Inspired by the .... because FG is neither from the movie nor inspired by it, I just wanted to relay that that is actually the title of the album, and not something that MTV or VH1 chose to add, at least I'm pretty sure of that, so don't blame them. What I find a little upsetting, and I was wondering what other people thought about this, was that POY was also listed in the credits. I know that FG is on POY, but it IS the wrong version. I think it would have been better if they did not list POY in the credits. Why? If someone who is not familiar with the original(and IMHO better) version of FG really likes the new version and decides to buy POY, they might be disappointed. Granted, they might be pleasantly surprised by the original version, but you never know. I'm not mad about it, I just would have preferred that they didn't list POY. Actually, I would have preffered that they didn't put FG on the soundtrack at all, seeing as how it doesn't have anything to do with the mediocre movie anyway. I'm not sure, but I think it was put on there because Warner, who made the move, also owns Atlantic, but oh well. I caught Jewel in the "Innerchange Days" as I just happened to stumble across her one night out visiting a friend. As I posted at the Food for Your Soul site's guestbook, I miss the easy connection that we all had to Jewel as a person due to the intimacy of the setting(Innerchange,etc.). She is an extrordinary person to plumb the depths of. However, if not for her rise in popularity I would have lost her light and gift to my life as I live a county away from San Diego.Popularity is something better disscussed in high school and not between people that care for each other. In many ways, what's happening for Jewel now is a manifestation of the world trying to catch up to what we already know.. what she is and has earned. I for one won't deny her in any way for what she has spiritually or physically given us , individually or as a group.Friends don't do that... (or why I didn't like the Time article) So I've got this wonderful issue of time with Jewel's radiant face on the cover that has been brought to my very do by the good people of the United States Postal Service. After flipping past the "Galapalooza" Article (which coincidentally had a picture of my goddess Fiona that made her look FORTY!) I find the article on Jewel. What happened to me probably happened to most of you. Instead of immediately scanning the headlines printed in black, or even taking more than a cursory glance at Jewel's gorgeous golden tones, your eyes were drawn to the big red letters just a little under the center of the page proclaiming... *****LIVING IN HER CAR***** This was a bit too much for me. My initial excitement about Jewel being on the cover of such a large magazine was gone. Slowly this feeling has been building within me of "I KNOW she lives in a car already!" As every article I read or mention of her I see seems to make that its focus point. As a dedicated EDA I did trudge through the hash of ancient material in the article (Yes she's from Alaska, Yes she lived in a van, No don't ask her anything about Sean Penn) and closed the issue feeling very unsatisfied. It seems to me that every magazine, television show, and newspaper is trying to jump on the Jewel bandwagon by proclaiming her as a modern-day Cinderella-like rags to riches story. Look, here's this girl who lived in a van and now she's selling lots of CDs. Poor girl makes good, the American dream and all that. As Igor mentioned in an earlier post (fresh in my mind because I just read three days in one sitting) a lot of this has to do with the lack of new material making it's way to the public. But the worry about Jewel become overpublicized is going to become drastically real if people can find new and interesting things to say about her. Alaskan dirt and parental yodeling will only go for so long before the general public starts to get as tired of tired media attention as I and I'm sure some of you are. [I'm going to take a moment to issue a disclaimer here that I have nothing against Jewel for having lived in her van, nor do I have anything against anyone living in vans or indeed any other vehicle. Conversely, I have nothing against people who don't live in vehicles. Also I have nothing against American Indians, Native Americans, or Martians who choose to sell or not sell their vans or other vehicles regardless of whether or not they live in, on, or around them.] [Whew.] The media's best resource on these types of things is Jewel herself. The best bits of the assemblyline Jewel articles are the parts where the reporter/interviewer stops trying to analyze are mythologize Jewel and just gives a plain account of what she is doing and saying at that moment. The same thing, incidentally, that keeps fans entranced during a concert. My hope, then, for future reporters who may be reading this very digest looking for ideas for articles, is that enhanced media coverage can let the world know what Jewel is doing and how she is changing, not what kind of dirt she's still carrying around (even if it is from Homer).
