Losing Bunches To Bootleg As profits increase, so do raids on illegal industry The Recording Industry Association of America is making more and more high profile raids of bootlegers, yet more titles and more discs are available every day with (offically) unreleased songs and live music from everyone from Oasis to Elvis Prestley to Smashing Pumpkins. One of the biggest manufactures, San Marino, Calif. based Kiss The Stone Records, has a full web site (http://www.kts.it) and it takes out full-page color ads in Spin magaizine. Internet tape trading anda bootleg sales are taking this music out of big city and industry hands and spreading it as never before. Two recent releases also raise the stakes. The Bruce Springsteen "Lost Master" series raids everything from Springsteen's rough home cassette recordings to finished, polished and mixed studio tracks--material that would make the basis of a great box set someday. And the release of "Guitars Kissing and the Contemporary Fix" uses the master tape of a famous 1966 concert that was scheduled to be the core of Bob Dylan's box set. Bootleg fans have long argued that only the hardcore fanatics buy this unreleased material, so it doesn't hurt the artist. That arguement gets shaky with the Dylan and Springsteen rleases--both clearly full of material that is commercially valuable to them. So where do the fans stand? With all this rare yet illegal music available, what's their exposure? Despite the increase, the industry is still taking the hard line. "Bootlegging is a crime. If you're involved, be prepared to do the time," said Frank Creighton, vice president and associate director of anti-piracy for the RIAA. The Dylan and Springsteen releases are sure to bring down the renewed heat, especially since they're flourishing even after huge busts and confiscations on both coasts. "That's being looked at as a very egregious infraction," Creighton said. And it's not just the industry fighting back; the artists are as well. Bands such as Hootie and The Blowfish, the Dave Matthews Band, Nine Inch Nails, and even Pearl Jam, Phish, and the Grateful Dead have been signing affidavits allowing officials to take legal action against commerial bootleggesrs--all the while allowing fans to tape their shows. "There's been an ongoing impression that some of these bands that allow taping of their show" dont' care about bootleges, Creighton said. Yet the lines still aren't that clear, even for anti-bootleg artists. Phil Collins filed lawsuits that lead to one of the biggest crackdowns on bootlegs in the 1980s, but in a recent interview he acknowledged that some of his favorite albums are Beatles bootlegs of studio outtakes--far superior, he said, to the authorized "Beatles Anthology" series. Doesn't matter, Creighton said. The law is the law. "Knowingly or unknowingly, if they order this material, they could be subject to criminal action here in the United States," Creighton said. Theoretically, yes. Not only do bootlegs violate US copyright laws, but given the dubious nature of where the original tapes come from, consumers could conceivably be charged with anything from mail fraud to possesion of contraband to receiving stolen property. However, the RIAA emphasizes that it's not after fans. It's after manufactures and distributers. Being in it for the music isn't going to get you in trouble; being in it for profit is.
