I'm not a lawyer, although I work with lawyers. There is no difference between a tape and a CD as far as copyright infringement goes. And I, for one, have only a few compunctions about taping and trading from commercial releases that are not readily available in stores--Save the Linoleum being a fine example of this, as it has already hit a collectible level and is not carried anyplace I know of. And yes, I've looked. When it sells for $30, it is essentially no longer on the market. However, let me *strenuously* point out that the inclusion of a track from the BRAND NEW Rugburns CD, which they are promoting on their current tour (and which is terrific) is just damn wrong. If you want this track, go and get the CD. They need the money, and you'll love the music. I spoke to Steve when the Rugburns played the Wetlands not long ago, and he was charming and kind. I mentioned how happy I was that Jewel's music had led me to his music, and he eagerly pointed out that she sang on the new CD. She may or may not get royalties from that track, but *he* certainly does, and if you've seen them you know they aren't trucking around in limos on their time off. Now, I admittedly bought the CD second hand: he won't see any money from that, but I can't afford to buy a whole lot of new stuff (I buy almost all my music second hand), and that is legal and sensible. With the whole album in hand, I've happily promoted it to my friends, and next time the 'Burns do New York I have a crew I hope to drag down. But pull a single track and distribute it as an aside? Choppy waters. This has been done on other lists here and there (NEVER for profit) when an artist contributes, say, to a compilation which is clearly not going to be bought by most listmembers. In this case, though, I wonder if it's the right thing to do. If you like Jewel, the odds are you're going to love the Rugburns. Soundtrack stuff seems to me to be qualitatively different. Me personally, I don't buy soundtracks. Think it encourages some of the worst aspects of the Hollywood marketing machine. I don't care if the production company for "The Craft" loses a buck or two from me; I don't feel I'm stealing anyone's work, and I certainly would not buy it new anyhow. But using this Rugburns track makes me feel bad. Obviously, the above is just my pair of pennies. An it hurt none, do what ye will, and all. But I think it should be omitted from the collection. Something else could easily go in its place. The record companies compensate by signing fewer fringe artist giving smaller contracts to the real artists. The fan looses the most. I hate going to concerts that are only replays of the CD. No new material. No slow or fast or electric or with dialogue version from the artist that fears the instant bootleg. What happened to the live radio shows that would let many of us at least hear sold out or distant shows. Some of the sellers of this material are good people. Some are great fans and love the music. But for the most part they are organized criminals and will sell anything for a buck. You are helping criminal activity. I do not offer a solution, but would like to hear your thoughts. Why the hell has the album been out for so long with only ONE released song? I'm know nothing of the music industry, (I only own one CD) but something is not right here. Because about every song off of her one and only album has been released, each with a video. This gives a little more airplay/exposure don't you think? Although I have acquired a sixth sense about when the WWSYS video will be on (I don't even try to wait for it to come on the radio), I would really love to see more. I wondered what I was getting myself into when I first heard the CD, but now I love it. I want so desperately to hear more things that I have read the words to, but have no idea how they sound. She could easily have a dozen albums with all songs that she has written. Why only one? Alanis M. sucks live (or so I've seen on TV). Why doesn't MTV let her do an Unplugged or something? Sure, she was on the "House of Style, Prom Edition" but why was she on for about three minutes. She could have hosted the whole show. Which brings up another question. Does she want to be a big star? I feel bad for Dean "The Man" Harris who has not had the opportunity to stand eight feet away from her (even if it means a loud buzzing in the ears for several days), and might never get that chance. She's got to do one of two things: Become a huge star, and enlighten the world with her point of view. It got played on some AAA and adventurous Alternative and college stations, and disappeared. That was followed by the single remix of You Were Meant Me, with the same results. But then as I understand it, about halfway through the radio lifespan of the You Were Meant For Me, the big modern rock station in LA (KROQ I think) added Who Will Save Your Soul, a full year after the fact for some reason. Since the LA market is such a trendsetter, MTV quickly followed by adding the video into rotation. Actually Alanis is on her 3rd album, but the first two were only released in Canada. MCA Canada has a pathetic track record of getting their most prominent artists distributed in the U.S. They're also the ones who were unable to get The Tragically Hip exposure in the U.S., even though the Hip is such a talented band, and among the top-selling artists in Canada (The Hip have now switched to Atlantic in the U.S.). Anyway, Alanis got her break internationally when she switched to Madonna's record label. With celebrities like Flea (Red Hot Chili Peppers) on the album, and Alanis being the first artist out on Madonna's own label, there was some immediate interest from the media. Plus, You Oughta Know is a powerful song that deserved to do well in my opinion. Now, once an artist gets a big hit on the radio, the record company will play on that recognition factor, putting lots of advertising money behind the album and pushing the follow-up singles like crazy. The follow-up songs may not be as good (which is the case with Alanis IMO), but once the momentum is there it's easy to keep going. Alanis has reaped the benefits of that technique, and with Jewel's Who Will Save Your Soul now in the top 10, you know Atlantic has made her a top priority. The POY CD, which may have easily faded after You Were Meant For Me, is being pushed like crazy now, and you can bet there will be more to come from it after Who Will Save Your Soul has finally run it's course this second time around. It's unfortunate that the music business has so much more to do with the politics than the music. Some of the cream does rise to the top, and Jewel got lucky again and caught the break she deserved with WWSYS. It seems she's caught a _lot_ of good breaks along the way, but she's a hard worker and a real talent. You have to be happy to see someone like Jewel, who makes her music for all the right reasons, flourish among all all the manufactured hits and hype that seem to clutter the business so much.
