Actually, music is regardless when it comes to publishing rights. If the lyrics have been changed significantly then it can technically qualify as a new song. It's easier for her to just go ahead and file it as a new song (or her label) to protect the rights for the song than it would be to try and prove to a court later down the road that it was "similar enough to This Way," that she deserves royalties. Not to mention, if you don't file the song under some sort of publishing, then that means no royalities for the publishing rights. I've got most of our songs filed for our band through ASCAP in order to protect our rights to the songs. There's been several songs with the same music (or similar) that they definitely qualify as a new song. Think about Kid Rock when he wrote new lyrics over a sampled version of "Sad But True" by Metallica. Or, the numerous times Puff Daddy/P. Diddy wrote lyrics over instrumental versions of other songs. While they would have to credit the original artist, it wouldn't really be the same for Jewel since, #1 she is the original artist that performed it, and #2 if she just managed to change one chord here or there, even the music would be considered new. Well... the music for This Way was co-written by Rick Nowels... it wasn't just written solely by Jewel. So if Picture were that song, then Rick Nowels would have to be credited as a co-writer, right?? It goes, "Paint a picture with your mind, Nothing's crueler than the passing of time" and after a few seconds continues, "Say you'll stay... --Forever this way" The song also has a different melody and tune to it, even when she sings, "Say you'll stay forever this way." I'm going to assume that the song listed at EMI is the canon commercial song, because its just what makes sense. I doubt she's started recording for a new album already, when shes stated she wants to take a short break first. On a little semi-related side note, I got a Canon scanner with my new computer.
