The law sais we can't make a copy of a pre-recorded cd & SELL it. There's a big difference. It's not illegal to download music from WinMX, Kazaa, etc in any way because there's no money exchanged. The music industry just wants a piece of the action. - -- Join my forums! http://forums.delphiforums.com/dafanclub http://groups.yahoo.com/group/dafanclub http://groups.yahoo.com/group/jewelfans ------------------------------ Date: Thu, 30 Jan 2003 18:59:51 -0500 From: "Sandy" Subject: Re: [EDA] Re: Copyright Stuff I think the problem with downloading it *is* that there is no money exchanged - It's illegal because while people aren't making money off of it, they aren't giving the artist any money by downloading it - therefore, they are technically "stealing" possible income from the artist and the record company. Also - while I might not be 100% on the money with what I said above, since I'll agree I'm not all that knowledgable with the laws involved - one of the people you are replyling to, Larry, is an entertainment lawyer I believe, so he knows his stuff - if he says it's illegal, well - he'd be the one to know! ~ Sandy - ----- Original Message ----- From: "Lisa" To: Sent: Thursday, January 30, 2003 9:03 AM Subject: [EDA] Re: Copyright Stuff > How can it be illegal to download music when there's no money exchanged? > The law sais we can't make a copy of a pre-recorded cd & SELL it. > There's a big difference. It may be considered as stealing if the artist plans on releasing the material anytime, because less people would want to buy what they already have. Jewel is actually known for bring the most downloaded artist as well. Heres what she said in an article: "I have the dubious distinction of being one of the most downloaded artists. I have about 4.5 million records that have been downloaded, so it's 4.5 million records I wasn't able to sell, which makes my life harder--for nothing else other than the fact my label needs to make money off me or else they don't promote me. So it's hard for me to make records and keep making the kind of records I want unless I'm selling records," However, she also added: "but I think downloading is a fact of life and I think people need to figure out other ways to monetize their image and their success," The article can be found here: http://launch.yahoo.com/read/news.asp?contentID=210694 Its from October 2002 however. I have no idea if Jewel chose to do the ads or not. There you have it, though. Jewel's lost 4.5 million albums by it, so it *is* stealing. Even if its not released, it may become an issue if she wants to do older material sometime. To me, debating this is really pointless. The fact that its stealing and illegal cant really be debated. Its a fact. You can't wash the sin from your hands by debating it... But you are free to believe what you want if it is stealing in your mind or not. Youre still breaking the law. Personally I download mp3s. The only unreleased Mp3s I have are Jewel songs and my angelfood. Im going to buy her albums regardless. When I download a released mp3 by another group, I stick to one or two from that album. I want to know if the album is worthwhile. If their music meets my tastes, I'll buy their album. There you have it, my two cents, and Jewel's as well! Peace, Mark ------------------------------ End of jewel-digest V8 #32 **************************
