It gets much louder and brighter in the middle of "Sometimes It Be That Way." Then it is pretty much OK for the rest of the tape, although there are some muffled spots. Is it just my copy? Or is it that way on all copies? If I have a bad copy, would someone be willing to make me a better one? I don't have anything rare or exotic to trade. The Papparazzi get away with it because they do it OUT of STATE in places where it isn't illegal to sell a picture of someone you've stalked and harrassed or run off the road to get their picture. So if you take your pictures in CA and run to another state or country that doesn't have a law prohibiting the sale of pictures, since you own the negatives and are the only person with the pictures, you can make a killing. You can't make posters and get away with it, but you can sell the pictures to a rag newspaper and the source of the photograph would be protected. Take particular note what happens here. The photographer's identity is protected by the rag, since they have lawyers who will argue freedom of press. That's right, no one ELSE can sell that picture. Technically, neither can YOU produce posters without permission since you're profiting off of someone else's image and can be sued for a cut of the profits. If someone else uses your photo you can sue THEM for a cut of the profits plus a cease and desist on the use of that image. Copyright protects YOU from someone else stealing your photo or image. It doesn't give you a right to do whatever you want with it to make money- but it does depend on how you market or not market someone else's image. It's a really nasty gray area. There's also a loop hole in that if you produce posters but don't put the NAME of the performer on the poster (and the image is not really 100% recognizable), you can't really prove so-and-so is on it and so technically it isn't a poster of so-and-so. So an artist can draw up a likeness of Jewel and sell it as art and can do so as long as he or she doesn't claim it's Jewel. The moment you claim a photo or a likeness in a work of art is Jewel, you can be sued for a percentage of the profits. Keep in mind that you're riding likelihood of being sued here. Claim an image is Jewel you're distributing without permission of Jewel's team (even if YOU took the picture), your likeliness of being sued increases. Claim an image is Jewel you're distributing without permission of Jewel's team (even if you took the picture) and you're making tons of money ,your likeliness of being sued is 100%. Sell an image you're not claiming to be Jewel, your odds of being sued are lower but not impossible. On the other hand, you could produce a poster of Jewel, claim it's Jewel and give them away for free (I do mean FREE, eg. no recovery of production costs at all), and odds are no one will bother you as long as the image is in good taste. Now ideally if you were a reputable business person you'd talk to the person whose face you're going to be using first and get their approval- but that's an issue of ethics and it's unfortunately not against the law to be unethical in this country- as long as you don't break the law or aren't caught breaking it- hence selling to a newspaper rag. Most lawsuits are over a cut of the profits and a percentage of $0 profit is still $0. There's no law against giving away free pictures of Jewel or anyone one else as long as you're not trying to defame, hurt the reputation of, etc. The moment you do that (violate another's reputation), then it becomes criminal and you start going into criminal law as opposed to copyright law. However, most of the promo posters out there seemed to be licensed from Atlantic for publicity at one stage or another so that's something to keep in mind.
