It's academic, but the issue of copyright has been raised again like it was last month when the playing card idea was being floated. I had e-mail discussions with people at that time, and, as far as the legal research that I carried out was able to determine copyright is not an issue when it comes to the use of the sort of words being talked about here -- especially in the context of non-commercial applications. In any event, under prevailing U.S. copyright laws: Titles, names, short phrases and slogans can't be copyrighted -- but they can be trademarks. That's why there's a book called Leaving Las Vegas (by John O'Brien) and a song (by Sheryl Crow) and a poem (by Jewel) and nobody is infringing on anyone else's copyright -- because you can't copyright such things. Now if you're MacDonalds and you want to go out and legally register "You deserve a break today!" as a trademark, you can do that. So unless any of Jewel's phrases or slogans have been registered as trademarks then there is no legal barrier to using them for such good things as have been suggested on this list. Legally, you can put Who Will Save Your Soul or Hands Manifest Thought on a guitar pick, a playing card or anything else that you like. That said, the legality is really academic as any usage of these titles, no matter if the law allows, should only be done with the approval and knowledge of Jewel if it's in any way possible that the usage could be against her wishes. The love and respect everyone has for Jewel makes that kinda obvious. I guess it would be up to all EDAs here to decide if the guitar pick idea (or playing cards etc.) is one that would not be in keeping with Jewel's wishes. I don't think she'd object, but it's up to us all to consider such things (it'd be hard to surprise her with something like that if you had to ask -- but whatever people think is right is the only way to approach things. It's an ethical, not legal, question based upon the case law I've seen.) Now, back to the birthday. I'm willing to participate in a number of the ideas that are going right now (I'm not best suited for the poetry gift, though). I think I'm going to mark Angel Day or EDA Day by volunteering some time with the island SPCA (because I love animals and have always thought of doing something like that, but hadn't manifest the thought until Jewel's birthday discussion came up). As well, I might join in the guitar pick and charity ideas once they're organized or whatever... Also Kris has a terrific idea that I think he's working on... Never too much of a good thing! I had to go to an 8:30 class this morning and I was feeling rather blue and all stressed out due to the fact that I was so behind in my classes. After going to two of my classes I found out that I had two midterms next week! I had no idea that it was already that time of the quarter! Feeling all depressed, because my life had no meaning, I decided to go and check my P.O. box to see if I had received any more letters from the collection agency because my father refuses to support me! My P.O box is all the way at the top so I can't see what's in it, I just reach up and grap everything I can. Not to my surprise there was another letter asking me when I was going to pay my doctor's bill. I was just about to leave but then I decided to jump up to see if there was anything else in my mailbox. And yes there was something else. My first pack of Angel Food had arrived! As a newbie, I was unbelievably excited! I started screaming "Yes! Finally! Jewel! Jewel!" in the middle of the mailroom. Two other students looked at me as if I was crazy and started to back out of the mailroom. But I didn't care what they thought because I was the happiest person alive for those short, but precious, seconds! I would like to thank Tim for sending me my tape and I would also like to thank Megan, Kim, and Jen for taking the time out to make me one of the happiest newbie alive. One night, in high school, I was staying at a friends' house for the night. Her cousin had a Ouija board and *insisted* that we play it. I have a huge fear of Ouija boards and chose to stay on the other side of the room. As they played and asked their questions, strange things were happening. The TV turned itself off when the remote was sitting on the coffee table 10 feet away from *anyone*. There was the infamous cold wind blowing through the house when all the doors were shut, etc,etc. The worst thing was, though, that the board spelled out, "I'm going to make your life a living hell." And you know what? It might be coincidence, but from then on, this girl was involved in tragedy after tragedy. 3 months later, she had dropped out of school. 6 months later, she was in a bad car accident that almost took her life. And things kept accumulating from then on. I choose to stay far from those things because there might be the CHANCE that they conjure up evil spirits. I don't care about scientific research or university studies or whatever!! As we are so slowly learning, Life is really much more than the tangible physical attributes our meager senses show us. Life is composed of energy blending itself into various patterns to create matter, spirit, and time. Science can not control these forces and so, a few hundred years ago, it designed the Scientific Method to try to "prove" the tangible and "disprove" the paranormal. =( The word "paranormal" means 'outside the normal'. Science is used to describe the normal, and can not be applied to paranormal. Religon attempts to define paranormal by dividing it up into "good" and "evil", but falls into the same hole as Science: it just doesn't know. In fact, the western institution of "Science" was created by the Christian church to help in its endeavor rid the world of evil. If something was not sanctioned by God, and was not part of the 'normal', explainable universe, then it was branded "evil" and condemned to death and extinction. =( Western, (dare I say, Christian?), civilization is the about the only culture that brands the paranormal as evil, or worse, impossible. Most cultures revere out of ordinary occurences, taking them as signs from their god, or merely a reminder that we are weak in the face of nature. What it all boils down to is believing in yourself, that's all that really matters, if you don't have that, then you can basically say that you are lost......which by the way applies to me but that's another story ;-) and that's ok to be lost, cuz finding your way is where the fun is :-) I feel compelled to comment on the Birthday and Ouija situaltion now instead of clogging up the list with multiple posts... Here goes... I really hope everyone doesn't get carried away with Jewel's birthday, cuz that's what it seems like, everyone should do what they feel is going to make them happy, and others around them happy..... Now, the Ouija board, ok, again just my opinion.... I find it hard to believe that something bought at a convenience store or game store to have spiritual powers......and to fear the Ouija board as some do isn't rare but they shouldn't really fear it, i think that it was put in their heads early on that most spirits and the ouija board were evil, and then their subconcious kicks in and they automatically begin to fear it, it's sorta like after watching a scary movie and then going to bed, half of the time you're gonna dream about something that freightens you.... just my deep thoughts here folks ..... :-) Sorry for the length, but it was neccessary for me to unload......
