I am writing to you about someone we all may recognize, and that is an artist by the name of Jewel Kilcher. You may be recognixe her from such albums as Peices of You and various movie soundtracks. I was fortunate enough to see her live at a small venue in Minnesota called 1st Ave. My question is does anyone have this particular performance on tape. It was May 30, 96. Also Does anyone have a recording of the Tori Amos June 10 show or the Cranberries Aug 11 show both were in Minnesota. Please contact me if you have any information about any of those. Help, save meeee. Aahhhhhh..... My .02: I am currently on a very gradual regime to quit smoking. Most people say 'oh, yea, right!' My response is that I have quit many more difficult habits this year and damn it, I'll quit this one my own way. I cringe at people's flames against smoking. It is an extremely difficult habit to quit. There are many addicting substances in cigarettes, but the hardest part is losing the habit (or in Freudian terms, the oral fixation). Smokers should be encouraged to cut down and congratulated for effort, not flamed and trampled for having a 'disgusting' habit. (As far as disgusting habits go, take a hard look at your coffee or cola of choice.) I am down to 5-6 cigs a day and pround of it. Just months ago, I was smoking two packs a day. Hopefully, in a few more months, I won't be smoking. My .O2 on politics: If you don't vote, and don't get involved, you can't complain for the situation and state this country is in. Face it, voting is our way of putting in our .02. It is only two little cents, but it's what we have. I am all in agreement with any opinion that our current political system is corrupt and inefficient. It is very much so! But as Machevelli states in _The Prince_ "A political body is a reflec- tion of the people that it rules." This means those that we elect fairly or unfairly, reflect the values of our society. PLEASE, don't take this personally, but think about it. The way to change a government is to change the people. But, meanwhile, get out there, vote, and make all the difference that you can. Wiggly Tooth is the copyright holder of registered songs and Jewel owns anything in her intellect. I realize that Atlantic and Sprynet, or as any service should, are actually covering their own butts for Jewels' sake and the protection of her material. I respect that and am pulling the Lyrics from any and all links and indexes on my site until I can get an OFFICIAL yes or no from Wiggly Tooth (Jewel). If Atlantic sicks the legal Hmmm. This is one of those areas that's been made grey by the courts as much as anyone. Services like Genie and AOL, who actually provide and moderate discussion groups for their members, have been held liable for what they failed to stop. Compuserve, however, was NOT liable for some materials in some case whose details escape me. The defining difference was something in how they approach the providing of service. If they are providing a pipe, that is to say, an access point for you to reach some outside service, it's not their problem, any more than the phone company is held liable for people plotting a crime over telephone lines (or commiting them, i.e. electronic banking). If, however, they take some steps to limit you, like the way AOL censors certain words, etc, then they are taking legal liablity upon themselves, because it becomes their content as well as yours. So if Spry provides unmonitored web space that you simply create, it's hard to say. If they censor for content in other areas (i.e. no nude pics), they have to censor everywhere. I guess if they're chasing after you, you could try to point out any matter that might be deemed harmful to minors, etc., and remind them of the can of worms they're opening. Was this related to the lyrics? Was it ever verified that the messages were really from Atlantic and your ISP? I'd note that "cease and desist" legal orders generally require verification of delivery, and internet mail is NOT considered reliable, the last time I checked. It seems likely that if they really want to stop you, they'd do it in writing, first. At least, it was something like that. Anyone willing to admit they're an attorney or someone who is skilled to give legal advice? (actually, they probably couldn't give counsel like that here, because they'd be risking their standing putting their name to legal advice without full info, which could hurt them in court, but never mind that :) ) I'd settle for someone who has details of the cases applicable. Oh. The other thing to remember, is that a provider cannot restrict you from the services they are selling you in the contract. If you have violated the contract, they can suspect your account, which at least means they don't get to charge you for any services. If you find that your pages have been blocked for a reason other than usage (since you do only pay for whatever usage), keep track of the time, and make sure you get refunded based on that. If you signed up for payment in advance to get a discount, you would also be allowed to demand refund without penalty, since they're opting out of the contract on you.
