We had been discussing the sudden onslaught of "custom CD" posts and the potentially very negative effects that I personally am a little concerned about. Like I said, I will not be able to answer any email the next week or so. So please dont write to me. Just think about this: Hi Dan, First I just wanted to check to make sure my package arrived safely. I hope you are enjoying the DAT and agree that it'll make a real nice addition to everyones collections. Also I must say that all these posts about making CD's has got me very concerned. This is exactly the kind of thing I didn't want to see happen. I thank you for your post about this and agree with you on every point you made. I can tell you that I've recieved a lot of private email from various people who have said they absolutely NEED my DAT recordings for this purpose. I have turned them all down and caught a lot of shit because of it. Most offer me a free copy of the CD (and are nice people,I'm sure) but a few have offered $$$ which leads me to believe that a bootlegger will eventually take advantage of Jewel's popularity. While it is inevitable, that someone is going to end up doing a boot CD of her, I want no part of it!! This is exactly the situation that puts me in a very precarious position. Do I provide tapes that will wind up in the wrong hands knowingly? I surely don't want to. I too would feel a lot less uncomfortable if Lenedra gave a CD project her blessing but I'm certain she would NOT. A point that is being overlooked is Jewel's contractual obligations to Atlantic. I'm sure that part of her LEGAL agreement requires that ALL CD's be manufactured and distributed through Atlantic. This whole thing has got me worried and I believe it could jeopardize a lot of things(including the recording and distribution of Jewelstock!). Feel free to post this letter (in whole or in part) to the list. I just wanted to speak with you first. Hope all else is well..........Alan Bershaw That was my feelings a week or so ago. I decided at the time not to post this in hopes the idea would fade away. Since thats obviously not happening, I just want to tell you all that the CD currently being offered is definately an ILLEGAL use of copywrited material and may jeopardize future distribution of high quality tapes on this list. You may also want to consider the fact that it puts Lenedra in a position where as Jewel's manager she may be forced to cut all ties to a list that is facilitating these things. There is a big difference between trading or distributing UNLISCENSED live recordings FREELY among friends as opposed to paying for manufacture of a CD of ALREADY LISCENSED & RELEASED recordings. The person who pays to manufacter the currently offered CD is wide open to legal prosecution (even if he has only good intentions). So is the company/person who is actually making the CD's. I'm not worried about what could happen to them. I only fear for the people totally uninvolved that could be effected by thier actions. I think it would be worthwhile to consider the big picture. Something doesn't seem right when one person offers a CD for 18 dollars and another offers one for 10. I see the point about copywright infringement but I was wondering if it would still be the case if we were to send a blank CD for a copy of whatever the distributor has. This is the same thing as the tapes but only with a CD. Is a CD a medium that has different laws then tapes? After all, Radio Angels does have that stuff from Phyllis Barnabee ... I don't know if that was cleared with the bigwigs so this could be a stupid statement. I am writing because I am a little confused here. There seem to be some contradictions. I think this should all be cleared up before anyone starts distributing CD's. I was at that concert...standing front row of course. First off, let me say that Jewel sounded amazing for that first song. (This was my first chance to see her.) Just so everyone knows. But, I don't really think that the person who threw that frisbee intended to hit Jewel. This was a "modern rock" festival. Just to name a few of the other acts...Pres. of the USA, Foo Fighters, Cracker, No Doubt..etc. Not that any of these other bands are bad or anything, but, they're just not the same style of music as Jewel. Most of the people there were crowd surfing and the like. The whole day people were throwing stuff up on stage. I can understand Jewel being upset, but as I said, I don't think it was intentionally thrown at her. I can imagine that it is pretty hard to play to 50,000 people when you're used to playing for a coffee house. Probably a lot different than she's used to playing. Well, I guess that's it. And there has always been that type of spirit amongst the people here on the list too (that's what makes it so unique). In keeping with that, we have always respected what is fair to Jewel in trading her music here, even if we haven't followed the letter of the copyright laws in doing so. Until recently, there has been a sort of unwritten understanding about "what goes" with the trading. The people behind the tapes most of us own have stuck to these concepts from the beginning: - - No cash or other profit will be made in exchanging Jewel's music. - - Nothing that can be bought at a store goes on a tape. Jewel's friend Steve Poltz makes his living from his Rugburns income. Out of respect for both of them, Old Lover's House from the Rugburns CD has not been included on the "Rare" tapes. Neither have Jewel's soundtrack songs, which she probably sees a small return from. Promo CDs like Phyllis Barnabee aren't available through normal retail though, so those songs have been taped for those who can't find a copy of those CDs. We enjoy an incredibly priveleged arrangement here, where Jewel and her Mom (and manager) actually like the tapes on the list. Not only that, but they're giving us our own private "Jewelstock", and permission to make the best tape yet out of it! So as far as exchanging material on CD instead of tape goes, I'd like to see everyone respect Jewel's and Lenedra's wishes on it. If Hiranya tell us they don't mind, then great. But if the word is "no", then it should definitely not happen. Thanks everyone...
