Times online Jury Convicts Actress on Two Counts in Shoplifting Case By RICK LYMAN BEVERLY HILLS, Nov. 6  A jury found the actress Winona Ryder guilty of felony grand theft and vandalism today but acquitted her of felony commercial burglary in the theft of several thousand dollars of goods taken from a Saks Fifth Avenue store late last year. The judge allowed Ms. Ryder to remain free on bond and said he would sentence her on Dec. 6. Ms. Ryder, who listened impassively as the verdicts were read, could receive anything from probation to three years behind bars. Ms. Ryder, 31, was detained by security officers as she left the Saks Fifth Avenue branch on Wilshire Boulevard in Beverly Hills on Dec. 12, 2001. The officers said they found $5,560 worth of stolen merchandise, including a cashmere Marc Jacobs sweater worth $760, various Frederic Fekkai hair adornments worth about $600 and several pairs of socks, including a cashmere pair from Donna Karan worth $80, inside two shopping bags and a garment bag. The security chief, Kenneth Evans, testified that he and others had followed Ms. Ryder's movements in the store that day on closed-circuit cameras as she went from one designer boutique to another, twice going into fitting rooms with armfuls of items. Another security guard, Colleen Rainey, testified that she peered through the slats in one fitting room door to see Ms. Ryder, scissors in hand, clipping sensor tags from some store items. "She came, she stole, she left," an assistant district attorney, Ann Rundle, said in her closing statement on Monday. "End of story." Mark Geragos, a defense lawyer, argued that Ms. Ryder was being set up by a conspiracy of Saks security officials and an overly zealous district attorney's office intent on capitalizing on the high-profile trial of an Oscar-nominated actress. Ms. Ryder was twice nominated for an Academy Award, for "Little Women" (1994) and "The Age of Innocence" (1993). She won a Golden Globe in 1994 for her "Age of Innocence" performance. Mr. Geragos said the Saks employees had hoped to avoid a civil suit by planting evidence on Ms. Ryder and then lying about what happened and what she said to them. He suggested that Ms. Rainey had not only lied about seeing Ms. Ryder cut off the sensor tags, but had shortly afterward left the store's employ and perhaps even tried to capitalize on the case by selling her story. "They've got all the best reasons in the world to fabricate evidence," Mr. Geragos said. The defense also denied that Ms. Ryder had made statements to security officials on the day of her arrest that she had only stolen the items because she was doing research for a future role. The defense suggested that Ms. Ryder had mistakenly believed that Saks sales clerks knew about the goods she was taking with her and would simply charge her for them. "There is a collapse of objective evidence in this case such that you cannot say without a reasonable doubt that Winona is guilty," Mr. Geragos said. The six-day trial drew widespread attention in the news media, both because of its high-profile defendant and because of the presence of Peter Guber on the jury panel. Mr. Guber is a former studio chief for Columbia Pictures who made no fewer than three major films with Ms. Ryder, "Bram Stoker's `Dracula' " (1992), "The Age of Innocence" (1993) and "Little Women" (1994). A daily scrum of cameras and reporters assembled on the palm-lined plaza outside the Beverly Hills courthouse, and in the small gallery of Judge Elden S. Fox's third-floor courtroom. Why, Jay, why? This is a heads up that TK are on the bill again for the World Folk Music Association's 18th annual Benefit Weekend at the Birchmere in Alexandria Jan. 17-18, 2003. I volunteer with this group, which this year is honoring the Weavers with a tribute concert Friday night featuring Odetta and Weavermania. TK were last year's WFMA Kate Wolf Award winners and they have been playing these shows year-in, year-out, to help benefit WFMA's activities. They're on the bill for Saturday night's show which will also include Laurie Lewis, Jack Williams (next to Pete, he is probably the most incredible guitar player you'll ever see), Jon Carroll, Bill Danoff, Mac Bailey, Side by Side and, most likely, a reformation of something akin to the Starland Vocal Band. (Danoff and Carroll and Side by Side shared the stage with TK on New Year's Eve 2001 at Danoff's Starland Cafe in the District. Dick Clark in Times Square got nothin' on us.) TK are frequently asked to sit in with other artists during this show and we've got no reason to believe 2003 is going to be any different.
