Generally speaking, the principle is that when Person A writes anything, and Person B wishes to reproduce it verbatim, Person B must make what the law recognises as "reasonable" attempts to obtain permission from Person A. In practice, the energy with which infringements are pursued will depend on the attitude of Person A. You may get a thank-you card; you may get a solicitor's threat. Lou Reed is notoriously bolshie about people quoting his lyrics and anybody who dares, does so at their legal peril. In the delightful book keyboard player James Young wrote about touring with Nico, the lyrics of The Doors' 'The End' and Rogers & Hart's 'My Funny Valentine' are quoted verbatim, but Lou Reed's 'All Tomorrow's Parties' appears as follows: ...- / - - - - - - - - - / - - - - -, - - / - - - - - - - - - / - - - - , - - - / (etc etc) [Permission to reproduce lyrics refused] Even when permission is granted, I know of cases where artists (or their management) have asked for $600 for a two-line quote. By contrast, in my novel Under The Skin, I quote some John Martyn lyrics, credited as such in the front of the book. As far as I'm aware, no money was asked for by John Martyn or Warlock Music Ltd (the songs' publishers). I also quoted from a song whose composers/publishers couldn't be tracked down. The phrase "permission has been sought" was used in that case, the understanding being that if the composers/publishers got in touch and demanded money, or the removal of the lyrics from my text, we would then negotiate. Either way, I and my publishers would be fairly in the clear because "reasonable efforts" had been made to track down the copyright owners. Articles written by music journalists are covered by the same laws and conventions. Some journalists don't actually own their work, it belongs to the newspaper or magazine. Reproducing an article in such a case could be risky as the newspaper/magazine might have more aggressive legal representation than the writer him/herself. In general, though, you will find that the journalists most likely to write substantial pieces about alternative bands like Wire - Ian Penman, Biba Kopf, etc - will have often tag their articles (c) Biba Kopf, 1999 - thus giving a clear message that they own the material and they don't want anyone else to use it unauthorised. An exception is made for quotes "for purposes of review". In other words, if you quote a small chunk of someone's work in the course of a book or record review written by yourself. The understanding is that the bit quoted will be very short (a paragraph from a novel, or a couple of lines from a song) and that you are being spared legal consequences because you are helping to promote the artist's work. Reproducing an entire article copyrighted to a journalist would not fall into this category and I can imagine some of the journalists concerned being pretty pissed off if they saw their work appearing on the net without payment. I have first-hand experience of this, having been threatened with legal action after posting a certain article that had originally come from an American publication. This was despite putting full copyright information, credits, and a link to their web-site. It does depend on the copyright holders, and I suppose some are easier with this sort of thing than others, but it's certainly made me extremely cautious of quoting anything verbatim again. It's a rather drastic 1991 LFO remix (and, IMO, one of the very best Wir(e) pieces) of Take It, from The First Letter that also uses a vocal from the ancient New York City (see Behind the Curtain). You can find this piece on the CD4 of So and Slow it Grows, along with an Orb remix of that track, and the '90s John Foxx that is Nice from Here. I called Metro...they forwarded me to the Clubhouse (their ticket outlet, I guess), who said it's not listed yet, that nothing's on sale so far. Billions' website still lists 3/4 as the onsale date...guess not.
