["Anthony Ratcliffe" ] ---------------------------------------------------------------------- Date: Thu, 13 Dec 2001 11:12:20 -0500 From: rturingan@dico.com Subject: injustice... what do you guys think? if a waitress neglects to collect a tab for a patron, in most establishments the rule is that the waitress should pay for the bill. quite unfortunate for the waitress but this is my understanding of this situation. the money should not have to come from a performers cut of the cover. here is the low down. last week (december 5th) my sister's band, vyletz, played at the free times cafe in toronto. they were the first performers of the evening and drew more than two thirds of the people in the room, nearly 20 people. most of whom paid a substantial portion of the cover. unfortunately many people left after the vyletz had performed and this isn't strange for such a gig. strangely enough, the waitress didn't collect on one of the tables (this is NOT the first time the waitress has made this mistake) and assumed that it was a friend of the bands. due to their busy work schedules, the vyletz had to leave early, prior to collecting their portion of the cover. later that evening, my sister gets a call from the waitress (i don't know how she got her cell number) informing her of what happened. the waitress asked if my sister could inform her friend of the waitresses negligence. at this point, my sister is not even sure who forgot to pay the bill and is shocked that the waitress should call her up in that fashion. it is not the bands job to keep track of the food and bar tab, that is what the waitress is supposed to do. later in the week, my sister gets an email from the host of the evening, "jeff stone" informing her that their portions of the cover was paid to the waitress to cover for her mistakes (12 dollars) and that jeff still owed the band an additional 3 dollars. after sending an email back to jeff, stating that this was unfair, jeff replied saying that because the vyletz left early, they forfeit their portion of the cover and that the waitress was actually paid off through the "other" performers share. (the vyletz DID inform jeff prior to the show that they had to leave early cause my sister had to work very early the next morning). a number of things do not seem right here. the free times cafe is not a large establishment. the waitress should have been able to keep track of all her customers, but she didn't. so the money was taken from my sisters band and when it comes down to it, the vyletz were royally screwed over. i am not one to cause trouble, but i am also not one to idly watch from the sidelines. not only did vyletz attract 2/3rd of the patrons of the establishment that evening, but they have yet to get paid for their efforts because of the incompetence of the free times staff.
