This is very different from marketing products derived from such tapes. Commercially marketed CD's made without the artist's permission are seen as a threat by their record companies, as they fear the loss of revenue. There are two kinds of these products: pirated CD's, which mimic official ones, and should be avoided by anyone who cares about the artist - no, just avoided, period; and bootlegs, which are manufactured from materials derived from a variety of sources. As Steve the Fake Finn pointed out this second group is indeed a grey area. "Hush" is a true bootleg, made from a recording of a live show. "Diffidence" is much greyer, as 2/5 of its tracks are from commercially available CD's, 2/5 from Paula's Live From The Hard Rock Cafe appearance broadcast on VH-1 (btw, crediting a source does not mean that source is getting a penny), the rest from radio broadcasts. It is nearly impossible to control broadcasts, and such attempts as station ID's and broadcast warnings have very little effect. My opinion is that most people - the general public - will still prefer the genuine article. True fans of an artist are probably the largest group of consumers for these products, but I am sure that they will buy them AFTER already buying most or all official releases, not INSTEAD of doing so, and thus don't negatively impact official sales. So by this definition I am not a true fan, because it is unlikely I will buy a movie soundtrack so that I can have that one song by Paula that is unavailable anywhere else. (I am delighted, though, to have the Imago sampler, not only for the Paula songs but also two cuts by Aimee Mann, one of which didn't make her album.) I'm still a fan, just not obsessed or driven to be a completist. The bottom line is the bottom line, and I don't think these soundtrack albums typically sell well without a mega-hit, like "The Titanic," so the losses involved here are minimal. There's still that nagging moral issue, though. But someone will have to explain how a store can survive selling bootlegs. It seems to me they would be awfully easy to bust if anyone can phone order illegal product. Perhaps it all adds up to much less than we think. I've bought a few boots in stores before but this is the first time I've ordered any, and I must admit I'm feeling conflicted. I still think it would be a grand gesture for the manufacturers to send at least something back to the artists. After all, once the pressing and printing is done, it's all profit - no royalties, no taxes. They would have no income if it weren't for the musicians in the first place. The Grateful Dead's approach to these issues was to permit taping, a move which was perhaps forced by overwhelming interest in live tapes, but also by the band's usual inability to produce studio albums superior to live performances. They offset any losses in record sales (which were typically soft anyway) by touring so much, which fed the taping, etc, etc. Taping is also permitted by The Radiators, and I've seen plenty of taping at outdoor festvals. Jewel fans are probably frustrated by her lack of a follow-up album, so she may well view taping as a reasonable alternative. But back to the original question, which was, how does Paula feel about fans taping her shows? It was my "bright" idea to ask Phil, which I now regret. We are in a unique position in being so close to the focus of our attention, but this carries with it an extra reponsibility and degree of discretion. I don't want to put Phil in the middle on this, a potentially touchy subject. Sure, it sounds like all he would have to do is lean over at sound check and say, "Hey, by the way, . . ." but it's bound to be more complicated. While it would be nice to get a definitive answer from Paula, she surely is busy with other concerns. Ultimately, people have to make their own choices and follow their spirits, trusting to be guided by their better judgement.
