Boone County, Ky. Police Chied Edward Ammann declined to explain, but said he would release a public statement this morning. "It is our belief that premature release of information on this case could potentially jeopardize pending arrests," Ammann said. Francis T.O'Brien Jr., the attorney representing Philip M. Sullivan, 40, of Newton, plans a news conference this morning but also declined to elaborate, citing the ongoing investigation. "All I can tell you is that we will be in a position to release significant breaking news," O'Brien said. A clerk at Boone County District Court in Kentucky said that four charges against Sullivan-attempted rape, burglary, assault and harassment-were withdrawn in court yesterday. Sullivan, Coles's sound engineer and production manager, has maintained that a case of mistaken identity led to his arrrest as a fugutive at Logan International Airport Dec. 24 after customs officials found warrants against him. Police had said that Sullivan's name, social security number, and physical description, exactly matched that of a fugitive wanted on three felony warrants. An unidentified, 32 year old Kentucky woman accused Sullivan of assaulting and trying to rape her, and burglarizing her home. She provided police with details of Sullivan's description, and a copy of a note written in a blood that he allegedy left at her residence. The woman knew Sullivan worked with Cole, police said. Sullivan's attorney maintained he was on tour at the time, and not in Kentucky. Sullivan, who was reportedly seen in the Boston area and did not appear in Boone Countyt court yesterday, did not return phone calls for comment. O'Brien said Cole, a Rockport native recently nominated for senven Grammys, has been invited to attend today's news conference. Cole has recently said that Sullivan was mistakenly accused. It was disclosed today that authorities in Kentucky previously told Philip Sullivan of Newton, Mass., that he had been cleared of attempted rape and other charges, but asked him not to make that public because the investigation into the woman was continuing. Police in Boone County, Ky., reportedly told Sullivan the woman could face charges of filing a false report. In Boston today, attorney Francis O'Brien Jr. said the charges by the woman ``were completely fabricated.'' He said Sullivan ``is not only totally innocent, he is himself a victim of a crime.'' This makes me angry. I get the impression that Phil will turn the other cheek but this lady should be prosiquited to discourage other people from this sort of thing. Sullivan, Jr., we respond as follows. Mr. Sullivan is committed to seeking, full criminal and civil sanctions against Kerrie Allen and any other individuals who participated in the fabrication of criminal charges and evidence against him. Unfortunately, to comment further at this time on her motive or the specific aspects of future litigation could possibly compromise our ongoing investigation. The entire defense team also wishes to express its gratitude to the many supporters of Phil Sullivan. CORRECT BIOGRAPHICAL INFORMATION In some prior reports the following information has been misreported. The following is a correct statement of biographical information: 1. Mr. Sullivan graduated from Milton Academy in 1975. 2. Mr. Sullivan graduated from Indiana University in 1980 with a degree in classical studies (Latin and Greek) 3. Phil Sullivan began working for Paula Cole when her first album, "Harbinger", was released in the fall of 1994. Phil was at that time tour manager as well as sound engineer and production manager. This is common with a new artist. Phil remained in these positions until the end of the Lilith Fair tour in August, 1997. By this time Paula had grown considerably as an artist and the workload was voluminous. Paula and Phil determined that it would be best to bring, in a new tour manager, so that Phil could devote his talents to the live show aspects of the tour. STATEMENT OF PAULA COLE RELEASED JANUARY 14,1998 "I have worked with Phil Sullivan for almost four years and in that time I have come to know a man who is gentle, kind, loyal and truthful. Fortunately, East Boston District Court Judge David Lowy exercised his discretion under the Massachusetts Fugitive from Justice statute and released Mr. Sullivan on $7,500.00 cash bail posted by Mr. Sullivan's father-, after- Attorney O'Brien promised that he and Mr. Sullivan would voluntarily appear- in Kentucky. Following Mr. Sullivan's release, Judge Lowy was criticized by Kentucky authorities for allowing Mr. Sullivan out of jail. The charges against Mr. Sullivan have generated intense local and national media attention. His name, address and accusations of heinous criminal conduct have been published repeatedly. His association with Paula Cole has served as additional fodder for a media frenzy. At the same time, the identity of his accuser has never been publicly revealed. Although Mr. Sullivan and his attorneys were aware of the identity of his accuser as of December 26, 1997, her identity was never publicly disclosed by the defense. This was done as a good faith gesture toward the Kentucky judicial system which, albeit known to the defense as erroneous, had nonetheless labeled this accuser as a "victim" of Mr. Sullivan. On January 6, 1998, Mr. Sullivan voluntarily traveled to Boone County District Court in Burlington, Kentucky accompanied by Attorney O'Brien. He was formally arraigned and entered innocent pleas to three felony and three misdemeanor criminal charges. Judge Michael Collins, who had previously set Mr. Sullivan's bail in absentia at $102,000.00 cash, agreed to Attorney O'Brien's request to reduce the bail to $10,000.00 cash, an amount which Mr. Sullivan was able to post. While in Boone County, Mr. Sullivan was compelled to undergo criminal booking procedures at the Boone County Police Station, including fingerprinting and mugshots as well as formal processing at the Boone County Jail. In fact, it was while in the confines of the Boone County Jail that Mr. Sullivan received the news, via pager, that his friend and employer, Paula Cole, had just been nominated for seven musical Grammy Awards. What should have been a time for Mr. Sullivan to celebrate with Paula and the rest of her group was instead spent as a public spectacle, presumed by many onlookers to be guilty of one of the most heinous of crimes. The day before traveling to Kentucky, Mr. Sullivan was the guest of honor at a long planned 40th birthday party, which was attended by many of his closest family and friends. Although all in attendance had no doubt of his innocence and were confident of his eventual public exoneration, the pendency of the criminal charges nonetheless cast a cloud over what should have been another occasion for untempered celebration. Since the time of his arrest Mr. Sullivan and his defense team, Attorneys Francis T. O'Brien, Jr. and Robert J. Wheeler, Jr. of Wheeler and O'Brien in Boston, Massachusetts and Daniel Dickerson of Florence, Kentucky, have worked diligently to expose the truth in this matter. Today the truth has come out. The Boone County Police and County Attorney's Office have today publicly acknowledged that which has previously been established by the defense team, namely, that the criminal charges against Phillip M. Sullivan, Jr. and any alleged physical evidence hi support thereof, were completely fabricated. Mr. Sullivan is not only totally innocent of any criminal wrongdoing but is, himself, the victim of a crime. Kerrie Allen, the Florence, Kentucky woman who fabricated these charges, was a long time friend of Mr. Sullivan. Although many in the media have erroneously reported that the defense in this case was one of mistaken identification, and many have gone so far as to erroneously cite Mr. Sullivan and/or Attorney O'Brien as Sources of that information, this case has never been one of mistaken identification. It has from day one been a case of intentional fabrication. The fact that some of the prior stories relating to this case accurately cited prosecution sources as stating that Mr. Sullivan and his accuser knew one another, while inaccurately citing the defense as claiming a case of mistaken identification, unfortunately served to fuel a public perception of guilt in some circles. It is the sincere wish of Mr. Sullivan and his defense team that the same effort that was displayed by the media in reporting his arrest will now attach to reporting his exoneration. With regard to the specific dates and crimes alleged against Mr. Sullivan in the December 23, 1997 complaints the following information has been conclusively proven: 1. Regarding charges of November 14, 1997 attempted rape and assault upon Kerrie Allen alleged to have occurred in Florence, Kentucky at 4:00 PM. : On that date And time Mr. Sullivan was conducting preliminary sound check operations with Paula Cole In Minneapolis, Minnesota in preparation for her performance that evening. 2. Regarding the charge of December 11, 1997 criminal trespass into the Florence, Kentucky home of Kerrie Allen and leaving behind a threatening note: No one, including Kerrie Allen, ever claimed to have seen Mr. Sullivan in Kentucky on that date. Ms. Allen informed the police that Mr. Sullivan broke into her home while she was away and left a threatening note. Although the police never saw this alleged note, which Kerrie Allen subsequently claimed to have destroyed, they nonetheless sought criminal complaint against him, Mr. Sullivan was, in fact, in Massachusetts for the entire days of December 10th and 11th conducting business matters for Paula Cole. 3. Regarding the charge of a December 15, 1997 burglary into the Florence, Kentucky home of Kerrie Allen and leaving a harassing communication, to wit, a napkin with the name Phil purportedly written in blood: Kerrie Allen and possibly others created the note and attributed it to Mr. Sullivan. Mr. Sullivan was, in fact, in Massachusetts for the entire days of December 14th and 15th. In addition to conducting business matters for Paula Cole on those days, on the evening of December 14, 1997 he served as sound engineer for a performance at Boston's Orpheum Theater by popular Boston recording artist, Jen Trynin. On December 15, 1997 he performed work at Q Division, a nationally known and respected recording studio in Boston and later attended the Q Division Christmas Party in Cambridge, Massachusetts. 4. With regard to the charge of a December 17, 1997 assault upon Kerrie Allen, alleged to have occurred at her home in Boone County, Kentucky at 10:30 P.M.: Mr. Sullivan was, in fact, in Massachusetts for, the entire day and night of December 17, 1997.
