They claim Lifeson attacked them as they tried to force his son, Justin, to leave the party. Silva) Lawyers representing the Ritz-Carlton hotel in Naples, Fla. and the deputies have filed papers arguing the deputies acted properly when they arrested Justin Zivojinovich, who had allegedly become disorderly after someone made disparaging comments about the Boston Red Sox. Lifeson's real name is Zivojinovich. Justin Zivojinovich is his son. The filings respond to a federal suit that Lifeson filed in June, seeking damages for battery, unlawful arrest and false imprisonment. According to the suit, Lifeson's nose was broken in the incident, and his son was repeatedly Tasered. At the event, a New Year's party to ring in 2004, Justin Zivojinovich began singing on the hotel stage while the house band was taking a break. Hotel representatives told him to stop and, according to his lawsuit, he did, but they called authorities anyway. He was charged with resisting arrest with violence, and his father was charged with two felonies. Authorities accused him of pushing one deputy down a stairwell and spitting in the face of another. In April, they both pleaded no contest to a misdemeanour charge and received a year of probation. That means if they successfully complete probation, there will be no formal conviction. "Today closes a difficult and painful period in the lives of my family, my friends and myself," Lifeson said at the time. "But the sun is shining and it feels good."
