No, it isn't illegal to sell a multi-regional machine, but there is so much pressure from the movie industry and others (I forget whom) that manufacturers are being scared out of producing them. Or something like that. Here is what my friend Elsa (eminently knowledgeable) wrote to me about the Sampo DVD player that she owns and its history. "When Sampo started building this unit, they intended it to be a multi- region player. That is, it was intended to play discs from all over the world, something that most U.S. manufactured players won't do. However, the U.S. based MPAA (Motion Picture [something that starts with an A] Association), objected to the player on the grounds that it circumvents the "Region" scheme, which keeps discs meant for Europe and the UK from playing on U.S. players and vice versa. I should emphasize here that there is no law that prohibits the playing of legally purchased foreign discs. It's only the disc manufacturers' desire to limit the distribution of discs coming into play here. Legally speaking, for now, multi-region players are just fine. However, because there has to be a certain amount of cooperation between disc producers and player producers, Sampo acceded to the MPAA's request that the multi-region features of Sampo players be disabled. They were disabled by changing the firmware that ships with the players, so that the menus that change region and set the PAL or NTSC features are disabled." Then Sampo discontinued this player. BUT now they have another one which is being distributed by Discounts and Deals (Model 611i) which, until it is found out, will do the same thing. Discounts and Deals sells the normal model for about $140, but they charge an extra $50 or so to "flash the firmware" (doesn't that sound sensual?) so that it can read any region. If you do go this route, make sure that you order the unit with the "i", which stands for "international."They can be reached at http://www.discounts-n-deals.com/ and the guy I dealt with (Dave Moretto) seems to be a nice, knowledgeable guy. This is a bit misleading... but the whole situation's pretty muddy. Here's the nutshell version: The MPAA and RIAA wrote a bill they dubbed the Digital Millenium Copyright Act which amends and augments US Code Title 17 (the copyright act) in all kinds of weird ways. They made changes that were favorable to their industries at the expense of... well... everything else. But let's just note US Code Title 17, Section 1201. This section states (among other things) that it is illegal to manufacture or distribute any device that circumvents a technology that effectively controls access to copyrighted work commercially (and manufacturing or distributing such a thing non-commercially will set you up for a civil suit from any copyright holder that can claim that your device circumvents a technological protection measure they employ). Now, the region coding on DVDs is NOT considered a technological protection measure under the law. However, the simple scrambling on the DVD disc IS considered a measure that effectively controls access. So, if you want to implement a DVD player, you have to get permission from the DVDCCA (that's right... not the copyright holders of the movies that you're potentially providing access to, but some third party that just claims all rights with regard to DVD movies) to use their Content Scrambling System to decode the disc. And the DVDCCA's license for using CSS includes a requirement to enable region coding on your player. Therefore, any player that does not implement region coding but does implement CSS is probably implementing CSS without the permission of the DVDCCA and we'll find out soon in a case in California whether or not the DVDCCA can successfully sue people who implement CSS without permission... but they're trying. And they're trying against poor individuals who created software players first so they can get a nice fat precendent before they take on a company that produces hardware players and probably has resources to fight the suit. 2600 Magazine has already been found to be civilly liable to the Motion Picture Association of America for simply publishing a link on their website to a description of how to implement CSS decoding. So if your player can play an encrypted DVD (almost any commercial DVD) and doesn't implement region codes, there's only a limited amount of time before the MPAA or the DVDCCA (which is essentially the MPAA and the major consumer electronics companies) start actively trying to shut your player's manufacturer down. I just got back from seeing the Damned here in Tempe, AZ (nice to have a 5 minute drive home for once, rather than 5 hours from LA). I was caught in the crush at the front/center of the stage, about 2 feet back, which meant I usually only had 3 or 4 people in front of me. The show was tighter and seemed better paced than when I saw them before. Lots of energy, light on "hits", and the band seemed to be enjoying themselves. Another encore would have been nice. It was a bit warm in there (it hit 97F today), but the Captain kept some clothing on this time--a pink tu-tu and black panties, really lovely. I managed to narrowly avoid a couple of disasters--first my glasses got knocked off when someone dove off the stage (somehow I managed to catch them) then later, I noticed a friend's credit card on the floor and later found their license, too. Anyway, it was a total blast. Very recommended, if you still have a chance to catch them. Afterward, I headed for my car, and on the way, I crossed behind the venue. There was Captain Sensible talking to a group of people and signing anything they handed to him. I asked him if he would ever write any more songs with Robyn, and he said,"Yeah, if I can ever get ahold of him..." He hasn't caught any of the recent Soft Boys shows, so far, but said he would love to see them. Not anything too major or surprising, but I thought I'd relay that bit anyway.
