What if an acquaintance who worked for an insurance company or government agency could read the private notes of your psychotherapist, or find out if you or a family member have ever undergone drug or alcohol treatment? Would you want others to know whether you've ever had an abortion or been treated for an embarrassing disease? All of those things could happen if a regulation being considered by the U.S. Department of Health and Human Services goes into effect. I'm participating in an Internet campaign to kill this regulation, and I'm inviting you to join me. If we generate enough e-mail, we can bury this awful regulation. But we need to hurry -- because the it's scheduled to go into effect April 14, which is just two weeks away. Please read this short background news item, and forward this message to any friends, family, co-workers, neighbors, or other people you know who may be interested. Then go to http://www.defendyourprivacy.com and sign the petition. It will be submitted directly to your representative in the U.S. House and to both your U.S. Senators. BACKGROUND: By April 14, Health and Human Services Secretary Tommy Thompson must decide whether to implement the "medical privacy" rules submitted in the waning days of the Clinton administration. The rules, published in the Federal Register on December 28, 2000, mandate that every doctor and health care provider turn patient records over to the HHS and other federal agencies for "safekeeping" -- regardless of whether patients consent. The government could then share those records with third parties such as insurance companies, private marketers, and even police agencies. The result? Soon millions of government bureaucrats, clerks in insurance companies, HMO's and even drug marketing companies will have access to your confidential medical records without your permission. Specifically, this regulation would: * Allow the disclosure, without patient consent, of all medical records for "public health surveillance activities" and dozens of other purposes. Providers could refuse to treat people who refuse to surrender their records. * Allow private insurance companies to access the medical information and compile it into a database. * Permit police agencies to access medical records without a search warrant. * Give the government the right to access the private notes of a psychotherapist. * Allow foreign government officials to see Americans' health records, as long as the U.S. government claims it is doing it for a "national health purpose." * Assign every American a "unique patient identifier," whether you want one or not, by working in conjunction with the Health Insurance Portability and Accountability Act. The number would be similar to a Social Security number for medical transactions - and would make accessing an individual's medical records as easy as running a credit check. * Give direct marketers access to medical records, and allow pharmacies to share prescription records "for the purpose of marketing health-related products and services" -- all without patient consent. * Prevent patients involved in health research projects from accessing their own medical records. The government claims it is doing this to "protect" the privacy of your medical records. But if these regulations go into effect, you can kiss your medical privacy goodbye. In a free society, the government has no reason to have copies of your private medical records, and politicians have no right to release your medical records to others without your consent. But that's exactly what's going to happen, unless we can generate enough opposition to persuade Congress to stop these regulations from going into effect April 14th. Please forward this e-mail to any friends, family, co-workers, neighbors, or other people you know personally who may be interested. However, please don't send it indiscriminately; spam will only hurt our campaign. Then go to our web page (http://www.defendyourprivacy.com) and sign the petition. Thank you. ------------------------------ Date: Tue, 10 Apr 2001 16:43:46 -0700 From: "Andrew D. Simchik" Subject: let's get in the nude with Dr. Robert Moag >From: Eb > >It is absolutely "MOAG." First I want to say thankyouthankyouthankyou to all the wonderful Bay Area Fegs who consistently raise my concertgoing experience to new heights. If there's anyone out there who has been too shy to join one of these Fegstravaganzas, well, let's just say you are missing a wonderful experience. It all started back in 1996, when I went to see Robyn for the first time in many years (tipped off by this list) at the Great American Music Hall in San Francisco. As I scanned the room wondering who - if any - of the people in that crowd could be responsible for the daily wit and wisdom I was reading on Fegmaniax, I got talking to the person sitting next to me ...who turned out to be none other than our very own John Partridge. Buoyed by the positive experience of sharing the gig with a fellow Fegmaniac, the next time Robyn played SF I booked a table at Chevy's on 3rd St. in the name of "Mr. Feg" and waited to see who would turn up. The rest, as they say, is history. This time around, the "globe" that gathered before, during, and after the Fillmore show must have been up around the 30 mark - hard to keep track of everyone, and as usual the task of getting everyone in a single picture at the end proved impossible (though I think most people ended up in *a* picture). Highlights: - - A fun couple of hours with the lovely Stacy (aka Zelda Pinwheel") and her hubby (who, BTW Glen, although he may have told you his name was "Rob" to throw you off the scent, was "Kurt" to the rest of us - and another bass player, too!). - - Finally seeing Chris Frantz' *incredible* apartment. (Looks out over SF Bay and the Golden Gate - a million dollar view if ever there was!) - - The ever-expanding table at the Thai restaurant as more and more people showed up. (was it 16, 18..?) - - Meeting *more* new Fegs: Barbara, Frank, Jim and more (and welcoming Jay to the ranks of Bay Area Fegdom!) - - Seeing so many familiar faces - who seem like old friends even though we only meet whenever Robyn plays. - - Finding out that it *was* Stephen Welch I saw on the streets of London last spring. The world is small indeed! - - The appearance of John Partridge, despite having officially moved to the other coast - - Nur Gale bringing me a drink though the packed throng. (thanks again, Nur!) - - And finally... The look of ecstasy on Mark Gloster's face! The show? Well, you've heard it all by now - *awesome*! Despite Eddie's opinion that it was the "worst" of the west coast shows so far, *I* was completely satisfied. (and Eddie, don't worry - we are on the same wavelength: if asked my opinion, I give it, too. :) ). This is Robyn at his best IMHO, and while I certainly enjoy his solo work, I think being in a band both constrains his weaknesses (like timing...) and brings out the best in his playing and singing. Also, I have always held to the heretical belief that the Soft Boys is really a *Pop* band - OK, a slightly warped one - but it's the combination of Robyn and Kim that basically does it. So it was great to see them together again, and so obviously enjoying the experience. I don't know how many others on the list remember seeing them back in the 70's, but Robyn's oft quoted analysis of "more comfortable, less spikey" rang absolutely true with me. They were playing as well - better even - than I remember, but were somehow different for all that polish. You must remember they first appeared in the middle of a burgeoning punk scene, and supported - and were supported by - some "real" punk bands of the time (The kind who would be sent from stage after a couple of numbers by a torrent of beer - and, unlike Gnat's erstwhile buddies, these folks didn't bother removing the liquid from it's containing bottles and cans!). So, how could punk audiences be persuaded to put up with psychedelia, three-part harmonies and more chords than you could shake a Fender Telecaster at? The point was that they shared the same energy and attitude - just listen to Wading Through A Ventilator - I don't think they could get away with that today. Today's Soft Boys are more thoughtful, better musicians, more relaxed and less selfconcious - a winning combination in many ways. Different, though from the SB's of old - but hardly surprising, I suppose. I hope they do carry on and record together. Unlike some, I really liked the new songs - and Robyn is certainly not running out of ideas as a songwriter. I like the idea of a casual arrangement where solo careers continue and SBs events just happen every now and again as the mood takes them. Better than being driven by record companies or financial motives, anyway. Other notes: - - Yes, Eddie, Morris Windsor IS God. I'm a huge fan of his playing on record and by golly he does it live, too. AND all while hitting those harmonies dead-on. - - What the hell was Tom Dolby doing? Not much that was audible from where I stood, anyway. - - YFF "RAWKED"(TM Russ Reynolds) - - Whatsisname who was apparently a Flaming Groovy was downright bizarre. I was in stitches. Guitar geek corner: When Kimberley broke a string, that was a Squire Venus he was handed. Last made years ago and quite hard to find now (and on my want list, hint, hint) these were Squire's last attempt to take the brand upmarket and are far from the cheapo stuff Squire is usually associated with. Cool to see Kim has one as his backup. It was supposedly designed by Courtney Love, BTW, and bears an uncanny resemblance to my very own Vaccaro X-Ray. Other than that it was an all Fender line up (come on Fender, how about a lucrative endorsement deal?) I don't remember Kimberley playing a Strat before (but then these days I don't remember much of ...err). Finally, of course, loads of photos were taken. As soon as I'm done with taxes, updating the site is my #1 priority, so be sure to send 'em to me asap. I'll stop now as I'm writing this on a plane coming back from a business trip and we're about to land. I'll send this when I get home *before* I try to catch up with the digests and find everyone has said all this already... ~N ------------------------------ End of fegmaniax-digest V10 #117 ********************************
