In reality, of course, the thought of big companies going after casual hobbyists is a bit ludicrous (though, I suppose, not out of the question. ............................................................................................. It will be interesting to see just what comes of this. Rather similar legislation was enacted in the UK a number of years ago and I did hear of one guy who advertised trading in a music paper being busted and his tapes confiscated. However, again, this was a possibly an apocryphal story, as I never heard the name of the guy , apart from vague details about him trading King Crimson .Whatever, the bill certainly hasn't stopped people advertising that they trade tapes in the music papers in the UK (check out the mojo messages ). However the net could be a place where authorities could make life hard for traders if an employees trading page was part of an employers site, or pressure could be applied to the service provider , if the provider could be seen as an accessory in the so called offense. However, I can't see much happening on this issue, unless there are some zealous officials who have a virulent hatred of traders who decide to make an example of some major players , lets face it there are so many traders out there one would need some massive resources to try to do anything meaningful about net trading. No way are they going to stamp this out, as one could get around the problem by using a service provider in another country and by using PO boxes and aliases, or establishing contact via e-mail and then going snail mail to provide lists , etc. I have often felt a bit guilty when I trade as I would really like to give something to the artist for the enjoyment I get from the performance.Here in South Australia we had for a year or so an anomaly in the law which allowed companies to issu bootlegs and sell them legally as long as they made a royalty donation to the artist. This lead to some great shows being freely available to joe public ( as well as some bloody awful ones as well ) as well as being sold at a reasonable price. Initially they were $20+, but there being so many of them they soon went down to around $3.99 each and were sold in el cheapo retail stores. Of course, they closed the loophole after a year or so, but it was great whilst it lasted. Anyway, the point I'm trying to make is, could this be one way around the new legislation ?By making a royalty donation to the artist I would have thought one may be demonstrating good faith, but then conversely, it could be construed as an act for gain ( and if the legal profession got their hooks into this issue , this could be argued over forever).I suppose the only way to solve this is for artists to record all shows and make good recordings available by mail order for fans , with the proviso that the artist has the right of veto on what they would consider substandard shows .I know I'd much rather buy a recording of a live concert than a studio album, but its only artists like the Dead and RT that give fans the option. I think the Pastels' "Illumination" is the only brand-new album I've liked this entire month. Interesting philosophy coming from someone in psychology. On the one hand, one might do better to start early and think about what the past year has wrought and thus allow healing or dealing with it to begin. On the other hand, starting to dissect one's year before it has physically ended might suggest a compulsive or manic disorder in which one constantly questions oneself rather than allowing one to just have experiences. I don't see the point in best of/worst of lists. They just make people annoyed and start flame wars (nothing personal Jim, you were just trying to be interesting, I'm sure!). But since I'm thinking about it, The Full Monty was definitely a best movie of the year...! Marcy :) ps--someone mentioned a Prince concert as being great this year. We saw him at the Fleet Center in Boston and he was awful. It was my 5th time seeing him and he just sucked. His band jammed for close to half an hour and it was the same riff over and over and over. He hardly sang anything--he did lots of flirting with girls down front and running across the stage making erotic gestures but not really doing anything entertaining for those of us up in the boonies. We left early and did some other people in our section and they were as pissed off as we were. Alex is a huge Prince fan and would never dream of leaving a show early, but this one was such a dud that we couldn't bear it. A few people on the Prince group think his last tour wasn't so great but I have heard that there were shows that were wonderful. I think that the combination of losing his baby and massive commercialism are taking their toll on him.
