Reply-to: Papaleonardos.1@osu.edu Hey folks, just to let you know about something scary that happened to a friend of mine today. He's a major tape trader (DATS and analog), mostly Springsteen but also Counting Crows, Johnny Cash, Tori Amos, John Fogerty, etc. For the last year or so, he's had his trade list up on his web page, and has frequently conducted trades with folks who find him through his web page. Friday afternoon, after he'd gone home for the weekend, the RIAA (Recording Industry Association of America, or something like that) sent faxes and letters to him, his employer (who is also is internet provider) and to his employers' lawyers stating that they had received a tape from him, which violated copyright laws. [By the way, another friend forwarded me a message from the Mellencamp list a few days ago, which noted how the copyright law was recently amended to specifically include tape traders. The previous law only said that it was a crime to distribute tapes in exchange for something of value; the newly-reworded law clarifies that something of value includes other tapes. I don't recall off hand if the law bans the distribution of tapes if nothing is received in return. In any case, if there is interest, I will fwd that message to the list.] Back to my friend. When he went in to work today, he was summoned and told that his email accounts had been CANCELLED and that his web pages had been taken down. He was advised by a lawyer friend who deals in copyright that the RIAA will probably not pursue the matter any further, but his employer may (since he was apparently engaged in illegal activities using his employer's resources -- email service and web space). The bottom line is that these assholes are cracking down on bootlegging. In the last year the busted a number of "pros" -- manufacturers and distributers of boot cds. Now it looks like they're turning their attention to tape traders. If you have a trade list on the web, I'd take it down, or 'hide' it by not having visible links to it, that way you can just pass on the URL to those you wish to view it. And I probably wouldn't advertise the fact that you trade tapes in newsgroups or on the web. And if you get email or snail-mail from someone you've never heard of asking for tapes, it'd probably be safer to ignore it. I don't want to freak anyone out, but it looks like a reality that we'll have to confront. These idiots apparently just don't realize that they can never eliminate bootlegs, just drive them farther underground. Not to mention the crimes THEY are committing against history, since bootleggers preserve music history for future generations! Note that it was sent from an address that doesn't currently exist (cpapaleo@postbox.acs.ohio-state.edu), has that incredibly vague opening (no names, no places, nothing to relate it to reality), and all kinds of leaps of 'trust me!'. Note that he suggests all kind of drastic actions that would basically shut a trader down or make him all suspicious. This is meant to con the stupid. Smart people would take real information (like an actual case with names and dates) and choose their own plan of action. The writer knows that stupid people react to gossip and stupid people do what you tell them to do because "You know more than they do... at least about this". This is panicmail. If someone actually gets 'busted', we'll all know the person's name, hometown, and blood type.
