In general, these kinds of websites (tripod, geocities, myspace) need a ToS that covers their legal butt. When I go to MySpace and visit Happy's page, it isn't Happy or even Vickie that is distributing the content of Happy's page. It is MySpace. So MySpace needs a ToS that says that anything you "put" on "your" page, MySpace has the right to distribute. Otherwise they can't publish your page to third parties, i.e. me. Now that doesn't necessarily imply that these kinds of sites don't go overboard with their ToS. In the early days some of the ToS did basically say that anything you put on your page becomes owned by the hosting company. The stink that was raised caused most of them to add the language their rights being ended when you remove the content, and they should also restrict themselves to just the rights that they need to distribute the page to third parties in the ordinary course of running a web server.
