I used to belong to a regional songwriters' organization that included access to those services in the yearly dues. I'd strongly suggest that Ms. Rhodes and/or her label/agents look into that. #2 While I'm not a lawyer, I have some experience in this area. I think there has been some well-intentioned but inaccurate information shared on the list. I'd like to clarify based on my understanding/research/experience. A. Domain name disputes are NOT the same as trademark disputes. Most of the discussion (prior art, first use) is relevant to trademark disputes. Domain disputes are handled through arbitration processes and through the courts. Those arbitration proceedings will take into account some of the same factors as those used in determining a trademark dispute, but the same statutes DO NOT apply. B. Bluffing works. If a party is convinced that he or she will be taken to court and is likely to lose, out-of-court settlements are possible. It might only take a credible "cease & desist" letter. C. It is NOT true that a suit can not be brought in domain name disputes (although there is a risk that a suit could be found frivolous) D. It is emphatically NOT true (in the US) that first use is the only factor in determining the legitimacy of a claim. Continuous use is important, and scope of geographical use is important. If the registrant of happyrhodes.com hasn't toured nationally, the claim may be found to be lesser. E. This is massively complicated by the fact that it's an internatonal dispute.
