I'd hoped it would be taken as tongue in cheek as your own posts. I hold no malice towards you (as opposed to others, apparently). It is ridiculous that we are dwelling so long on this thread, I think the issue is "done" and we all know what we should or should not do, as good members of the illustrious ecto community. It's funny that I had to wait until I moved to the west coast to see Merrie Amsterburg live. Before tonight I only had one of Aimee Mann's albums - I'm With Stupid - and I never listened to it much. But the concert was great, and I have already listened to her preview EP (Bachelor No. 2) about 10 times. I highly recommend it. I was wondering if anyone can offer suggestions of San Francisco-area bands that are worth checking out. I've heard there are a lot of good ones, but I have no idea where to start. They stood in the face of corporate record company executives and showed that you could grow an audience by allowing concert recording. The successful outcome of their efforts is now the stuff of legend. However, wish (or Phish) for a better world though we might, it is illegal to tape a concert, and the stricture can be enforced by using that thin "piece of paper," a document similar in its origins to deeds and other property titles. David Home, the 18th century English philosopher, wrote that private property was the basis of law. The US Constitution so completely adopted this sentiment that it included an intellectual property clause, the first ever so framed (the English version depended on common law). Carried to excess, copyright law could be used to suppress the distribution of microphone "asides" made in a concert. If a performer wanted to follow such a course, the tape of the concert would need to be entered into the US Copyright Office with a written transcription before any legal action could be taken, but afterward the bootlegger could be taken to court. Arguments about the creative significance of the "asides" could go either way. The fair use provision could be invoked by the defendants, especially if the "asides" were distributed in an edited format as Foghorn suggests they might. This has been the nub of debates about sampling. Once seed material is significantly modified, the modification can become he property of the second source. I have little doubt that this imbroglio was triggered by either an artist or her lawyers. The Ectofest has everything to gain by distibution of recordings of this concert, and for one, I am extremely sorry to see to whole thing blow up in our faces. The organizers were generous to a fault with their resources and time. Admittedly, the artists were equally giving by virtue of their performances, but the spirit of generosity doesn't stop at Lake Kenosia's edge. I was also at the Aimee Mann show tonight. Aimee was incredible! Unfortunately, I can't really offer a judgment on Merrie, since the audience was talking so loudly during her set of rather quiet acoustic music...grr... For some strange reason, Aimee only brought 100 copies of her wonderful EP to sell at the show. They were all gone in a flash and two of my friends who wanted to buy them, couldn't. There were at least 450 people in the sold-out, VERY VERY crowded club. Why not start on Oct. 16 by checking out Emily Bezar and Amy X Neuberg and Men, two of the SF bands that have given me the most hours of pleasure and fun since I moved out here. I've seen them both numerous times and they're wonderful live. http://www.isproductions.com/amy/proj.shtml has the details on the Oct. 16 gig. Sadly, another one of my favorite local performers, Penelope Houston, just played what she claims will be her last show for a while LAST NIGHT, the same time as Aimee Mann. Sigh. However, when she returns to the stage, she's definitely worth checking out. If you like girl-with-her-piano type music, Alison Faith Levy is always worth seeing -- there are no gigs scheduled at the moment, but she plays live fairly regularly.
