If you were concerned about the artist's right that the work not exist, and I'm not saying that you're not, why are you lurking in a dark corner in the Coco Club in San Francisco, covertly recording a performance? I saw her open for someone (now I can't remember who--Katell Keinig?) when I lived in Minneapolis. Her songs have a droll sense of humor that I really enjoy, which is enhanced by her voice--which kind of reminds me of the lead singer of Wall of Voodoo (if he were female). There is kind of a sarcasm inherent in her voice that adds to her songs. One of my favorite songs of hers is Me and Shelley Winters--about a chance (fictional) meeting between her and the actress on a New York subway. I thought I'd written up a review of the show, but don't think it ever got through to ecto. My mail system was doing odd things the day I sent it out. Anyway, Erica Wheeler deserves some mention here. She's part of the New England folk revival (according to her press), and sings and writes very nicely crafted songs--largely dealing with nature. But what really won me over was her personality--very self-deprecating, joyful, funny. She sang a couple of funny songs--one about a cat who'd left her for the man next door, and another about sober Harley riders hanging out at coffee bars. But most of her songs are more serious, dealing with all aspects of love, and as I said, often using nature metaphors. She said one reviewer had written a very positive review of her CD (she has four releases out--the first only on cassette), but said she should get over the "Miss Sierra Club USA" thing. She said she knew he meant that as a putdown, but if there was really such a thing, she wanted to know how to apply. She was a very engaging performer. I picked up her latest album, Three Wishes, and really like it. Larry Campbell plays guitar on it, as well as a few other guest musicians--but overall it's a real tasteful album--not at all overdone or overwrought--but just right. She'd probably appeal to people who like Dar Williams, Lucy Kaplansky, Cry, Cry, Cry, etc. Her voice reminds me a little of Dar Williams at times, but is a little lower. Anyway, another artist to watch out for--especially if you get a chance to see her live. As for the position being taken, I can appreciate that, and in a more ideal world, that might be the case. However, consider: - - I'm not a legal expert, but I do believe that anyone does have the right to record what is going on in their environment: snapshots, videos, and audio recording. Certain limited exceptions apply, in particular phone conversations cannot be taped unless both parties know it is happening. But you can tape any sound in or around your home, for instance, and carry a running tape recorder everywhere you go. I don't think anyone can stop you. Nor should they be able to in a so-called free country. - - When you go to a concert that says no tape recorders or cameras that is part of the contract you signed implicitly when you bought the ticket. That is not law, those are terms set by the venue or the artist or the copyright owner of the performed work. Note that they must hire and educate their security team to enforce that. I've never heard of the community police enforcing this. - - If you go to a free festival, do you have the right to tape there? I think you very well might. Note that ectofest was essentially a free festival, access expected a donation, but no one said what would happen if one refused to donate. As far as I know the issue was not raised. But even so, if I stood outside the fence at ectofest (in a public park) with a running tape recorder, I don't think anyone could stop me. - - The point of all this, then, is not the existence of the recording, but the distribution of the recording. There's where legal trouble really begins. - - What about the converse, where the artist decrees that a recording should exist, but said artist does not own the copyright to all of the performed work? Or a distributor (record company, etc) is not willing to cooperate? Whose rights should prevail? - - Again, compare to photography: papparazzi make their living taking unflattering pictures of "performers", on and off stage. The laws have generally upheld their right to own copyright of such images, and be paid for their distribution. Unless the performer can prove stalking or other harassment, there's not much they can do about it. - - Because of their unofficial or underground status, generally only collectors know of and where to obtain audience recordings. The overwhelming majority of collectors who would consider acquiring such a recording know the difference between the quality of the recording and the quality of the performance. I doubt if artists worry about being represented by a poor quality unofficial recording. I think an artist would be more concerned with a bad performance of any fidelity being distributed. And even then, what's to be done? Like athletes in a bad game, resolve to do better the next outing. Prove to the audience the bad performance was a fluke. I'm not trying to argue with you, as I said I more or less agree with the spirit of your position, but the whole matter is far more complicated than that. And really beyond the original point: What Should Ecto Do? I believe I already know the answer to that: Ecto, *as a collective*, should have nothing further to do with such "questionable" recordings.
