Even in the Xenaverse people were shut down for copyright infringement. I remember very well one case in particular where an artist was caught selling Xena artwork on EBay and was ordered to stop by the studio. There is an enormous difference between dabbling in fandom and taking someone's creations and profiting from them without their permission. The publisher should have known this even if the fan didn't. Despite a lot of nonsense we hear from some fans, fans don't own the characters their creators do.
