In that specific instance, yes -- simply because the Taliban didn't steal the antiquities away from their native land, but completely destroyed what they had. Now these pieces of human history are lost to all of us forever. In the other examples you brought up, if the artifacts still exist and there is no reason they would be intentionally destroyed upon return to the people to whom they belong, then no, the museums, thieves, or militants don't have a right to them. (This is why one sometimes hears stories of a big-name museum such as the Metropolitan Museum of Art returning a piece of its collection, either to a foreign government or, increasingly, to a Native American tribal council.) It's a very sticky situation, granted.
