Mr. Kolton stated he never gave permission for another composer to claim authorship and collect what may be hundreds of thousands of dollars of writers9 royalties paid over the last 7 years by ASCAP and overseas performing rights organizations for worldwide broadcast performances of Kolton9s music in over 100 episodes of the series. According to Kolton, the music, written during 1995-2000, was composed at the request of composer Joseph Lo Duca, who Kolton says is listed as the author of Kolton9s music on the shows9 music cue sheets which direct who performing rights royalties are to be paid to. Lo Duca, who ASCAP has awarded twice as a top earning composer over these same years, is listed in industry references and on-screen as the music composer for the shows, "Hercules: The Legendary Journeys," "Xena: Warrior Princess," and "Young Hercules." The shows are currently in syndication worldwide. 3My goal in this is simply to correct the record and receive what I should have received in terms of royalties if I had been correctly listed as the author of the music I wrote in the first place. I bear no ill will towards the producers of the shows, and only want to correct the record in terms of the music I wrote that has been used in the shows,2 said Kolton. Kolton9s lawyer Brian Lee Corber of Los Angeles says the case centers on the fact Kolton never gave permission for another composer to claim authorship and collect writers9 performing rights royalties for music written by Kolton. 3Dan Kolton wrote this music,2 says Corber, 3and can prove he is the author of this music. The fact that someone else has claimed authorship of Dan9s music and has taken royalties that should have been paid to Dan has necessitated us taking legal steps to assert his rights as the true author of this music. The protections that our legal system has in place to protect authors of music and other works of art is the U.S. Copyright law, and that is why we9ve registered the music with the U. S. Copyright Office in Mr. Kolton9s name and are taking steps to ensure that Dan is listed as the true author of the music and receives all the rights and benefits that authors of creative works are entitled to.2 According to Corber, under the U.S. Copyright law, a writer retains full ownership and copyright in the music he writes unless there is a written agreement involving the writer wherein the writer gives up or transfers copyright or works under a written "work for hire" agreement as an employee of the composer. According to Corber, there was no written agreement between Kolton and Lo Duca, and Kolton worked as an independent contractor. Corber emphasized that at no time did Kolton transfer copyright to anyone else or give Lo Duca the right to claim that he had authored Kolton9s music. When asked about Kolton9s claims, Joseph Lo Duca had no comment, and a spokesperson for Universal Television and Studios USA was not available for comment. These are always a highlight of the Cons. Run by Anita Ellis they benefit the Ellis Foundation at Hoffstra University. The foundation helps college students who either have or had cancer or whose parents have cancer. This is year the girl who spoke had her whole family there and they seemed to be having a great time - her little cousins danced up a storm with one of the Xena fans. We had a lot of fun dancing and generally acting like fools. Of course Tim, Hudson and her parents, Claire and Danielle were there. They went from table to table and posed for pictures. Hudson was on her best behavior and rolled around on only one table. They now have it down to a science and everyone got a picture,. I however wish we weren't so intent on picture taking (I'm sure by now a lot of us have more than one picture of us with Claire, Tim, and Hudson) - it was always more fun just to have the guest sit down and chat. I remember those moments from past breakfasts with a lot of fondness especially the year Meg Foster and Ebonie Smith were at Cherry Hill - they were so charming and very friendly - I'm glad I have the pictures but the pictures just remind me of chats. Someday I hope Renee comes to the breakfast but I suspect there might be chaos with everyone trying to get pictures _ it was little like that with Michael Hurst in Pasadena. Anyway if we can behave Renee would have a good time I think. There was also a silent auction. Lots of autographed stuff from Renee - cereal box, scripts, posters. There was Vagina Monolog playbill signed by Lucy also. They raised about $7000. I was outbid on most things but I got another Renee autograph picture ( all gold seating people got an Renee autograph picture jeeze she must have gotten writer's cramp). Sunday's program started with Renee's Shakespeare video again. Then Tim came on. He was very funny about his adventure coming to the Con. His nephew was running around by this time and Tim had a little chat with him. He also talked about Judging Amy and encouraged us to e-mail CBS and give some good feedback about the show and especially Tyne Daily. He seemed to implied that TPTB don't quite appreciate her - which is odd since she is the reason for watching the show, isn't she - oh I forgot she's over 50 so of course no one would be her fan - now would they or so the studio execs would think. He also thank the fans for our loyalty and said some things that made me think he wasn't quit happy with CBS. He said the cast and crew of Judging Amy are all quit nice but that it just wasn't like Xena where he was treated always liked a welcomed guest. That after fours years on Amy and 20 odd appearances it is the 6 Xena episodes that has given him the most recognition. He sort of reminded of the guy who worked for a small company and had lots of friends and rewarding work and then went off to a big impersonal company and makes more money but misses the camaraderie of the small firm and wishes he was still there. Young" Subject: [chakram-refugees] OS: Bob Trebor in Universal Soldier I knew Bob Trebor had been in Universal Soldier with Jean-Claude Van Damme from his credits I perused for our recent Hawai'i Xenafest, but I couldn't remember exactly what his part was. By chance, local station KHON reran Universal Soldier this afternoon and I got to see Bob in action. ;) Let's put it this way, he plays "mercenary" and "sleazy" _very well_. ;P He played a somewhat nosey and lascivious motel desk clerk at the first motel Van Damme's and the heroine's characters check into while on the lam from the bad guys.
