The FCC can decide, after the fact, what's indecent - with no effective means of appeal to a court of law. There was almost no opposition to this bill by either party. It will likely sail through the Senate. It's literally only a matter of weeks before Howard Stern (and other controversial personalities), with 18 million daily listeners, will be forced off the air, rather than risk massive fines for himself and his stations, that would cripple their businesses. And there's virtually no opposition among the frightened politicians. Washington -- The House on Thursday approved sharply higher fines for broadcasters and entertainers who break indecency rules, as Congress moves closer to cracking down on incidents that are deemed to be obscene or profane. The Broadcast Decency Enforcement Act of 2004, which passed 391-22, would give the Federal Communications Commission the ability to levy fines of up to $500,000 per violation, up from the current $27,500. Because many shows are syndicated and played on numerous stations around the country, fines could run into the millions of dollars.
