See, this is why in my perfect universe, every member of the RIAA would be dipped in a huge vat of boiling lard. Just because you download a music file for free does *not* mean you are breaking the law. The RIAA would love for that to be the case, but it's simply not true. Case in point: I maintain the web site for a musician named Christine Fellows. She regularly sends me MP3's to post on her site -- demos, live recordings, and even a couple tracks from her album when it came out last year. There is a download option, and she is perfectly happy to have people download the tracks. As with most independent musicians, downloads are a great way for Christine to introduce her music to new people. But if ISPs change their user policies to state that they will revoke your account if you are found to be downloading any type of music file over their system (which I fully expect them to do -- it's their only legal recourse if this ruling stands, really), this essential part of the independent musician's publicity mix will be wiped out. And that's just stupid and wrong. But the RIAA doesn't give a damn about independent musicians, so I'm sure they won't be at all sad to see that happen. Janis Ian, who has been on major labels and is now a proud indie, vehemently disagrees with the RIAA's stand on the issue and has written very eloquently on this subject.
