What you do in private is your business. I really do not wish to make specific charges, so let me state my case in general hypothetical terms. Suppose, Jim Lawn(JL) accused Avalon List as being group of profiteers and pirates. (Why would he do that?) Further assume that JL is a very big collector of BF/RM stuff and that he goes way out of his way to find the rarities and oddities. Let's say he goes to Ireland, Belfast, to meet with a young list member(GM) who is also a trader. JL discovers that GM has a copy of a BF work that was stolen from Virgin's vault. Mr. Lawn sets off with an invective generalizing Avalonians as all the same... Curious, considering JL already showed his wares, and among the lot was JL's very own copy of the same recording! JL, the collector, goes away angry - realizing his ace trading piece is devalued. He has lost some control; of the once very rare trading piece's distribution. In retaliation, he makes a public accusation casting all Avalonians in an unsavory light. Meanwhile, behind the Avalon List scene there is a small group of well intentioned persons who decide the above must be kept secret because of potential legal problems, hushed up for the sake of the list. However, this splinter group's intentions run contrary to the natural flow of information, and the many questions that have surfaced on Avalon List have been effectively squelched through intimidation and through discrediting the person(s) who ask too many questions. That this matter continues to be discussed and argued off list, is proof that the issue is not dead and can not be contained. Nor should it be contained since the Lawn accusation effectively dragged the whole of Avalon List into this very bad situation. I (one member of the approximately ninety plus percent of Avalonians who have had no role in the fiasco) began searching for answers months ago, trying to make sense of the very strange happenings bleeding through to the list. What I've discovered is alarming. The splinter group includes some individuals who are not Avalon list members - all traders and all with their own copy of said material. The initial copy of the unreleased material seems to have made its way, innocently enough, into an Avalon List member's possession via internet connection in one of those sprawling quaint habitats. The problem is, the recording was already in the public's hands but when JL discovered other channels of distribution had formed, he blew a huge big whistle. Is it coincidental that bryanferry.com has disabled its message board and greeting book? Why has that site's interactivity been shut down? If you are not concerned, given the current environment of copyright disputes, that record companies are very keen to protect their interests, then you will not be too alarmed by the unfortunate situation Avalon List has been thrown into. I am not condemning trader's desire to collect, but when that obsession drags innocent people into the quagmire then something is very amiss. I venture to say, if we are not vigilant, Avalon List may very well be shut down. Some members should not be surprised when deposition time rolls around, when Virgin Records decides it's ready to move. Is it really fair to the general population of this list, to endanger our fellowship, for the sake of a few traders who lost their sense of discretion? The copyright issue is so hot right now that the web sites of traders who offer unreleased studio material for trade are here today and move on tomorrow attempting to remain one step ahead of the law. Please, do not let Avalon List become their haven, their new little cyberspace. I am well aware of illegal material on some of our cd/vcr trees. That material could come under fire. But the real big thing, the holy grail here, is an entire unreleased album owned by Virgin Records has been publicly outed via Jim Lawn's foolish accusation. Not only are we under a cloud of suspicion, his statement dredged a plethora of issues that are of extreme interest to Virgin. At heart, I place the welfare of this list much higher than I do the collection of stuff. There are places, easily found - I can attest, where you guys can safely do what you do without involving Avalon List. Please. I do not wish to point fingers or participate in a brawl. The recent irritation I have displayed on list is the result of the down pressure enforced upon us. I remain grateful for the cd/vcr trees and the enormous contribution of material to the list by collectors. But this is a serious matter, and it has escalated out of our control. The next move is Virgin's. The law, unfortunately, is on their side - not ours. Best wishes to all, and Simon, I'm sorry for the excess of words. They commented how Bryan ought to pull his finger out and put out some new original material. They also referred to his appearance in the tabloids last week, and how he'd been a naughty boy. This is beginning to sound like a broken record, exactly where are you going with this series of postings? Don't you think your crusade against Jim Lawn has become just a little over the top? I'm all for caution when it comes to dealing with unreleased studio material, if my memory serves me well didn't Colleen make a number of postings on this topic around the time "Strictly Confidential" was treed? You say that you are "grateful for the cd/vcr trees and the enormous contribution of material to the list by collectors", but "place the welfare of the list much higher than I do the collection of stuff". Does this mean that you will not be taking receipt of any future treed item? Please make your position on this clear as there does seem to be a contradiction in your stance on trading/swaping and treeing of items. I personally don't see much of a risk if any to the mailing list as long as any trading/swaping and treeing is not being done for any financial gain. Let's be honest if all the folk who like to trade items off list were to leave avalon it would mean the end of the cd/vcr trees for starters and secondly reduce the amount if information passing through the list. If someone has a piece of memorabilia which he wants to sell be it a book, poster or tour jacket I think it's better to let the fans on the list know first rather than it going to a dealer who will then sell it on at an inflated price. Surely that is part of what the "fellowship" is all about. Isn't it about time you realize that you have had your say on this matter? If somebody else wants to take it up then that is up to them other wise it makes one consider that you have an agenda here which you are not being totally up front about. No doubt folk are getting as fed up of reading my reply's as they are of reading your complaints. I'd be quite happy for it all to come to a halt here and now as I've said as much as I want to on the subject. To be honest I'd prefer to be making arrangements for the last of the open air shows at Castle Howard and working out who I'll be meeting where before the show.
