Also, what's the local economy like? That makes a big difference. For a $40 hair treatment with an excellent stylist, I tip a minimum of $5-10 depending on what my situation is. I can't afford to fork over $10-$20 in tips every single time I go out. Look on the bright side though, I've never NOT left a tip, and I'm the first to go to the manager when there's bad service. I go on my way out the door, as there's no way I'm sending food back or anything like that. Who cares about a complimentary meal/appetizer/dessert that the cook and wait staff most likely spit in? They ARE mainly collectables, and collectors dont usually buy from collectors unless it is a legendary (20+ Year) artist. It was like you were reading my mind, except the part where you said frigg a go go got good. I thought they totally sucked. POE needs to do something about her set, not only what songs she plays but how she plays them. On the first tour she had a much more aggressive set. On this tour even "trigger happy jack" and "angry johnny" lack the energy they once had. Songs like "control" and "walk the walk" could be beefed up with bigger sound. Look at when she used to do "hello" it rocked, it was a high energy heavy song. live, very unlike the album version. I just think she needs to beef it up a little and that band has to really shape up. That's just my little addition to your take on the subject. Turns out he has between 20-30 Masters by Poe. He also has a bunch of computer records. He will sell them ALL to me and agree in writing that he is selling me everything he possesses or has access to that is Poe related for 15,000 bucks, if I can get him 7,500 in the next 24 hours. I can get the money, but the question I have is should I?? This is Poe's music and it should NOT be out there like this, especially the unreleased stuff! Fortunatly everything this guy has has been saved in digital format by Pail and Atlantic. These tapes vary between 2" 24 track masters and 1/2 inch stock. It is an interesting legal question about who "owns" them! It is Poe's music, but by contract it "belongs" to Fishkin ( who retained the Poe contract and did not sell it as a Modern Records asset) and Atlantic Records, who DOES own a portion of Poe's contract. This guys argument is that Fiskin sold Modern Records to Randy Jackson with certain assets, one of which was this storage locker. Question: Who's responsibility is it to make sure everything that does NOT go with the sale is removed from that locker? If Modern Records or Fishkin had found out that the Poe material was in there Modern Records would have had to return it to Paul. But it appears that nobody checked to see if any of Paul's stuff was still there (according to the guy that bought it.)) At some point the storage contract goes into default for non payment and it is sold legally under CA law to the lowest bidder. When he inventories what he has bought there is Poe stuff there. He is not privy to the sale of Modern Records contracts. He THINKS he has the legal right to sell what he legally bought----but does he??? I buy a storage locker at auction, there are 10 TVs in it. The police knock on my door and say they understand I have a TV that was reported missing or stolen and they check serial numbers and 9 are clean, but one was reported taken from a house without permission and not returned. The guy that has the storage locker shows a receipt that he legally bought that TV from HIS neighbor Bubba. Turns out Bubba stole it. Guess what? Cops take the TV I legally bough as stolen property and give it to the guy Bubba stole it from and neither of the two people that "legally" bought it get reimbursed for anything! Rather they are told be happy we don't bust you for possession of stolen property!? I really don't know what to do! I hate to see these tapes disappear, but it sounds like even if they do Pail, Atlantic, and Poe still have the digital copies. I wanted to ask Poe what SHE wanted, but Craig and Paul both feel it would be too upsetting to her to find out these were out there! Especially the unreleased stuff. I talked to two of my lawyers and they say that if Paul turns in a stolen report on these tapes the cops will secure them till it is duked out in civil court who "owns" them. The guy that bought them at the auction sent me copies of two emails he sent to Poe@poe.org. It is doubtful she saw them, but at least he really did try contact Poe. I guess there is no listed number for Modern Records so maybe he is telling the truth about not being able to contact them. Paul says don't give the guy a penny more, my lawyers ( two of them ) say the same thing. The 750 and the other auctions shows he was trying to sell them and did accept money for them. This guy needs money badly, I told him I wanted to know a FULL count of EVERYTHING that he has Poe related, including the computer records. I want one price that assumes the material goes to Poe directly and that he will assure in writing that he has sold me all the Poe and Poe related material ( tapes and paper records) he possesses.. This is a hard one for me, I need your advise on what to do! I don't think this guy should get any more then he put into it. What I HAVE offered him is that if he shows me the receipt of what he paid for the storage bin I will pay him every penny he paid for the FULL bin. He gives me all the Poe stuff and he still has hundreds of Stevie Nicks and all kind of other stuff to sell that is PURE profit. If he doesn't go for that I think I am going to tell him he will have to deal with Atlantic's lawyers and if he sells any of it, possibly with LAs finest :) Where is Mark Furher when you need him! Like you said they still have the digital copies. So the material would not be utterly lost. So now it is just a matter of determining who owns the rights to the material, of which I believe the scales tip far towards Poe and her team. Furthermore, why on earth would this chap force you to come up with the money in only 24 hours instead of a more reasonable time frame? What is the big rush? Is this some sort of ransom? Are we holding tapes hostage? He seems very unscrupulous. Anyone who would make demands of that nature cannot be a very trustworthy or reputable individual. And lastly, someone for god's sake needs to tell Poe immediately. Would it be better for him to sell it all and for her to find out after the fact when it eventually surfaces that everyone but her was privvy to all this? As you stated, this is her material after all, and shielding her from this information only does her a great disservice. Furthermore, hiding something of this magnitude will only cause her to distrust you guys when she eventually does find out. And besides, she should be allowed the most input as to how she wants this problem handled. It should really be her decision how she wishes to deal with it, and not yours, though I know your intentions are supremely noble. We would see silver bootleg/pirate CDs made with the demos on them, and then have to pay $20-$30 for each CD to an independent record store, who would pay far less for them and resell them. Consumer CD writers weren't available, so we would be trading and making tape trees out of it using cassettes. In that case, I'm sure these master reels really *would* be going for that much, maybe even more, but not available on anything like eBay.
