JOSEF HEBERT Aug. 31, 2000 | WASHINGTON (AP) -- Citing a presidential order against discrimination, the Interior Department is reviewing whether it should end some of its ties to the Boy Scouts of America because of the group's ban of gays. Interior asked the Justice Department for advice on how to deal with the Boy Scouts in light of an executive order in June barring government involvement in educational and training programs with any group that discriminates on the basis of sexual orientation. That request prompted a mid-August memo that was circulated widely within the department seeking detailed information about "all activities, events and programs" Interior has with the Boy Scouts to determine whether they conflict with the executive order. Word of that inquiry prompted a sharp response Thursday from congressional Republicans and some conservative groups, who characterized it as tantamount to "an attack" on the scouts. "The Boy Scouts are not a hate group," Rep. J.C. Watts of Oklahoma, chairman of the House Republican Conference, declared in a statement. He accused the Clinton administration of "investigating" the Boy Scouts and "political pandering" to gays. Interior spokesman Jon Wright said the department has no intention of severing its ties with the scouts, characterizing the memo as part of an attempt to get clarification on how the June executive order might affect the relationship. "We have a long history and tradition with the Boy Scouts and we look forward to continuing that relationship," said Wright. "It's a win-win situation all the way around." He said the department helps scouts obtain conservation merit badges, and that scouts also often help clean up campgrounds and trails. The June 23 executive order by President Clinton, which applies to a variety of other discrimination as well, was issued five days before the Supreme Court by a 5-4 vote ruled that the Boy Scouts could constitutionally exclude homosexuals as members or scout leaders. Justice spokeswoman Kara Peterman said that while the department is continuing to develop general guidelines for the executive order, it has issued no advice to Interior or anyone else specifically involving the Boy Scouts. "We haven't even looked at it," she said, adding that when Justice received the request, Interior was told to produce more information on what involvement the scouting organization has with them. On Aug. 15, Interior Solicitor John Leshy asked all of the department's agencies to provide details on their activities involving the Boy Scouts "in an effort to determine which activities and programs ... as they relate to the Boy Scouts of America are consistent with Executive Order 13160" on discrimination. That prompted still other memos within the department including one from Nattie Silva, assistant director, diversity and equal opportunity at the Bureau of Reclamation. Existence of the Silva memo was first reported Thursday by the Washington Times. The memo sought information on Interior's involvement in next year's Boy Scout Jamboree at Fort AP Hill in Virginia, as well as involvement in other scouting activities including sponsorship of events, monetary and non-monetary assistance, sponsorship of any scout troops, and any award, certificates, patches, merit badges or other forms of recognition that might involve the scouts and the department. All of this has caught the Boy Scouts by surprise. "I'm stumped," said Boy Scouts of America spokesman Gregg Shields. He said as far as he knows the Boy Scouts have had little dealing with the federal government. Shields could provide no specific examples of dealings scouts have with the Interior Department except that "we may camp on federal lands." He said one program involves weeklong camp outings for intercity youngsters where the federal government in some cases pays to house and feed the boys. "That's small dollars," said Shields, adding that he was not sure which federal agencies was involved.
