ENTHUSIASTIC aspects of Frühead-dom. Other Bands I like, in no particular order: Ben Folds Five, TMBG, The Arrogant Worms(if you see a Worms ref in #MF, it's very likely my doing), BNL, Cake, The Foremen, Jo Carol Pierce. Lotsa oddball Canadian bands in there, I know. I wonder if that's an identified pathology. Gawds, and don't get me *started* on Canadian Bass-Players. Heh. Even if I *don't* know their names. Such drinking age laws are legal for the same reason those goons at Costco are allowed to confiscate and search my backpack when I go shopping there. It is because the Constitution, and all it's pretty Ammendments, only applies to the Federal Government, or agents thereof. 14th Ammendment protetions prevent the U.S. Congress from specifically creating discriminatory laws, and allows (or requires, depending on your point of view) the Supreme Court to apply the Equal Protection concept to decisions it makes. All minimum drinking age laws are set by the individual states or territories. (With the exception of we disenfranchised residents of Washington, DC, but that's another story.) This is because of the 10th Ammendment, which says that if it's not delineated in the Constitution, the States can take care of it. Up until the mid-eighties, about half of the states had 18 as the minimum drinking age, at least for beer and wine. Then came Candy Lightner, founder of MADD, and Ronald Regan's favourite cause of his first term. Lightner pursuaded Regan and Congress to withhold federal highway money from every state whose minimum drinking age was below 21 years. The funding clause was to go into effect with the 1987 federal budget, but was never tested because by that time, all states had fallen in line. (Then Lightner was forced out as president of MADD, but probably for reasons unrelated to her associaton with Regan.) So each state got to make it's own law, and the federal government only had to do a little arm twisting and not pass an Ammendment or anything. (That last sentence reads as though an Ammendment is a kidney stone. I guess they both affect your constitution. ) One might possibly argue the constitutionality of minimum drinking ages by suggesting that they illegally restrict interstate commerce (Article I, Section 8) in that Tennessee is being prevented from selling Jack Daniels to teenagers in Kentucky. But I doubt such an argument will work. Many of the underage drinking issues are related to driving while intoxicated.
