This provoked an angry, even = hostile reaction from me. I am now sufficiently calmed down to = attempt expressing my dismay in a more civil tone. I hope you'll forgive me, Ms. Coller, for observing that perhaps you = have not been paying attention. The proposed shirt is NOT FOR SALE. = Any monies that might change hands represent the costs to produce and = ship the shirt. This is a not-for-profit endeavor. In addition, = we'll be lucky to get orders for a *whopping* thirty-six shirts at an = even more *stunning* Fifteen Dollars Each! What? Is someone going to bring suit against us for this? Paul, = this is your call, I suppose. But I cannot imagine we would be = infringing upon any artist's rights in a significant fashion by = producing this shirt. Nevertheless I have appealed to the immediate source of our image, = Barbara Cohen, to do two things: 1) obtain a hirez scan for the final = artwork, and 2) research who owns the image so we may satisfy the = %#$^&#$ing lawyers. = Geez, ya never know --- we might crack a global market with this = thing. Barbara remained silent until I = posted her last week with the above. She's out of town until = mid-next-week, and will look into it upon her return. She's not too = hopeful though; she doesn't remember what website she got the image = from, and it was some time ago. Not hopeful at all. So, chilluns, I'll make one more appeal to you. Whomever Has A = Copy Of This Picture, Please Come Forward! Otherwise, we're gonna = have to flush it . . . Meanwhile, a number of private conversations have occurred concerning = this project that have not made it into this: our mutual drawing = room. It's great to hear from other people who know that "spam tin" isn't a Monty Python reference. I recently got a new TMDR compilation from Germany that I assumed everyone here knew about. But since it doesn't appear in Lazlo's new discography update, I thought I'd share the information. The compilation contains no new or rare music (though the long version of "Airwaves" is sorta rare in North America), and only has selections fron Dolby's first 3 (EMI) albums, plus Urges. Firstly, Mary wasn't, and isn't imposing anything on us. She felt hesitant about saying anything - which is why she quietly approached me instead of posting direct - but thought she should try to help by speaking up and I, for one, really appreciate it. All she did was suggest that it may be an idea for us to take a minute to clear it with the owner of the original work so we avoid the chance of anyone's noses being put out of joint. She was genuinely looking out for our interests here: it's unlikely Lost Toy People, inc. would own the photo so she really didn't have to say a thing if she didn't want to help. Secondly, I really don't want this to be my call, I don't think it's my right. I have no more claim on Alloy than anyone else here, I just happen to be the guy who dusts off the furniture every now and again and tries to coax the lurkers out of the shadows. That said [ :-) ] if you want my humble opinion I think we should at the very least try to get an okay from the owner of the photo beforehand. I know we're all wanting to get on with it but I think it's the right - and polite - thing to do. I know the term "licence" conjures up images of swarms of lawyers & fees, but it doesn't need to be a heavy thing. It could be as simple as sending an email to a photographer or a studio saying "hey you remember that photo you did back in '87?..." We know it can be this easy, since Mary was happy to say that doing the tape project would be fine for the scope we're looking at. Who knows, you may just make someone's day by asking if you can use his/her work. I know I'd be royally chuffed if it were me. Let's give it a go eh? If it gets too hard then we just use another image, say BC's photo. No big deal. Oh, and if it helps any, all we really need to give us a good chance of finding the photo is the original filename it had when Barbara grabbed it, add an image tag and fire it off to a few internet search engines. cheers, and all the best for tomorrow!
